        abstract = {Tujuan penelitian ini adalah untuk menganalisis penerapan SPBE pada Dinas
Komunikasi, Informatika dan Statistik Provinsi Lampung dan menganalisis
kesesuaian penerapan SPBE pada Dinas Komunikasi, Informatika dan Statistik
Provinsi Lampung dengan prinsip tata kelola pemerintahan yang baik (good
governance). Jenis penelitian ini adalah penelitian hukum normatif-empiris, dengan
menggunakan data primer dan data sekunder. Pendekatan penelitian menggunakan
pendekatan perundang-undangan (statute approach) dan pendekatan konseptual
(conceptual approach). Hasil penelitian ini menunjukkan bahwa penerapan SPBE
pada Dinas Komunikasi, Informatika dan Statistik Provinsi Lampung memperoleh
indeks 3.37 atau masuk dalam predikat baik sebagaimana data hasil evaluasi oleh
Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Tahun
2023. Dengan perincian yaitu domain kebijakan dengan indeks 4.70, domain tata
kelola dengan indeks 3.30, domain manajemen dengan indeks 1.64, dan domain
layanan dengan indeks 3.63. Hal ini sesuai dengan Teori Bekerjanya Hukum
William Chambliss dan Robert B. Seidman, yaitu Pemerintah Provinsi Lampung
sebagai lembaga pembuat hukum memberlakukan Peraturan Gubernur Lampung
tentang SPBE. Bekerjanya hukum sesuai dengan peraturan ini berkaitan dengan
adanya kekuatan-kekuatan (pihak-pihak) lain di luar pemerintah provinsi, yaitu
para pengguna SPBE dari instansi pusat, pegawai Aparatur Sipil Negara,
perorangan, masyarakat, pelaku usaha, dan pihak lainnya. Penerapan SPBE
Provinsi Lampung memiliki kesesuaian dengan 8 (delapan) dengan prinsip tata
kelola pemerintahan yang baik dan sesuai dengan Teori Good Governance, yaitu
penerapan SPBE memenuhi kepastian hukum berdasarkan regulasi baik di tingkat
pusat maupun daerah, penerapan SPBE memenuhi asas kemanfaatan bagi
penggunanya, ketidakberpihakan dalam pemberlakuan Peraturan Gubernur
Lampung tentang SPBE, aplikasi SPBE yang memberikan layanan secara cermat
kepada penggunanya, perangkat daerah tidak menyalahgunakan kewenangan dalam
aplikasi SPBE, keterbukaan/transparansi dalam penerapan SPBE, adanya
pemenuhan kepentingan umum, dan pelayanan yang baik kepada masyarakat.
Namun demikian, penerapan SPBE Provinsi Lampung masih dihadapkan pada
kendala yaitu masih kurangnya pemahaman masyarakat tentang SPBE dan belum
meratanya sosialisasi SPBE kepada seluruh Aparatur Sipil Negara (ASN) pada
Organisasi Perangkat Daerah (OPD) di lingkungan Pemerintah Provinsi Lampung,
serta domain manajemen yang masih masuk dalam kategori kurang.

The aim of this research is to analyze the implementation of SPBE in the Lampung
Province Communication, Informatics and Statistics Service and analyze the
suitability of the SPBE implementation in the Lampung Province Communication,
Informatics and Statistics Service with the principles of good governance. This type
of research is normative-empirical legal research, used primary and secondary
data. The research approach uses a statutory approach and a conceptual approach.
The results of this research show that the implementation of SPBE in the
Communication, Informatics and Statistics Service of Lampung Province obtained
an index of 3.37 or was included in the good predicate according to data from
evaluation results by the Ministry of State Apparatus Empowerment and
Bureaucratic Reform in 2023. In detail, namely the policy domain with an index of
4.70, the governance domain manage with an index of 3.30, management domain
with an index of 1.64, and service domain with an index of 3.63. This is in
accordance with William Chambliss and Robert B. Seidman's Theory of Legal
Operation, namely that the Lampung Provincial Government as a law-making
institution enforces the Lampung Governor's Regulation on SPBE. The operation
of the law in accordance with this regulation is related to the presence of other
forces (parties) outside the provincial government, namely SPBE users from central
agencies, State Civil Service employees, individuals, communities, business actors
and other parties. The implementation of SPBE in Lampung Province is in
accordance with 8 (eight) principles of good governance and in accordance with
the Good Governance Theory, namely the implementation of SPBE meets legal
certainty based on regulations at both the central and regional levels, the
implementation of SPBE fulfills the principle of benefit for its users, impartiality in
implementation of the Lampung Governor's Regulation on SPBE, the SPBE
application provides careful services to its users, regional officials do not abuse
their authority in the SPBE application, openness/transparency in the
implementation of the SPBE, fulfillment of public interests, and good service to the
community, but the implementation of SPBE in Lampung Province is still faced with
obstacles, namely still a lack of public understanding about SPBE and the uneven
distribution of SPBE to all State Civil Apparatus (ASN) in Regional Apparatus
Organizations (OPD) within the Lampung Provincial Government and
management domain which is still in the deficient category,
