LANDREFORM DI DESA BANJAR AGUNG KABUPATEN LAMPUNG

%X Redistribusi tanah merupakan salah satu program landreform yang
diselenggarakan guna meningkatkan taraf hidup petani. Salah satu cara
memperoleh hak atas tanah melalui redistribusi tanah objek landreform, objek
redistribusi tanah adalah tanah absentee, tanah swapraja dan bekas swapraja tanah
kelebihan maksimum, dan tanah yang dikuasai oleh negara. Dalam kajian ini
dilakukan untuk mengetahui pengaturan hukum terhadap redistribusi tanah dan
pelaksanaan kegiatan redistribusi tanah.
Metode pendekatan yuridis empiris merupakan teknik nonrandom
sampling yang dipilih dengan parameter tertentu, penelitian dengan data primer
dan sekunder yang dinilai secara kualitatif dengan memisahkan dalam bentuk
kalimat yang selaras dengan pokok bahasan yang diteliti.
Kajian terhadap pengaturan Pemerintah nomor 224 tahun 1961 tidak
sejalan dengan perkembangan saat ini, sehingga diterbitkan Peraturan Presiden
nomor 86 tahun 2018 dan menghasilkan penerima atau subjek sebanyak 600
bidang tanah yang berasal dari tanah transmigrasi atau tanah negara terlaksana
dengan adil dan merata.

Land redistribution is one of the agrarian reform programs calculated to improve
farmers' livelihoods. One way to obtain these fonciers droits is to redistribute the

land that becomes the object of reform. The objects of land redistribution are no-
man's land, land controlled by tenant farmers and land controlled by no-man's

tenant farmers with a maximum area and land controlled by the state. This
research is conducted to determine the r?glementations juridiques relating to land
redistribution and the implementation of land redistribution activities. The
empirical juridical approach method is a non-randomly selected research
technique with certain parameters, a research using primary and secondary data
that is evaluated qualitatively in the form of phrases that match the object under
study. The study of government regulation number 224 of 1961 is not in
accordance with the developments that have occurred, therefore presidential
regulation number 86 of 2018 has been issued and has regulated the equalization
and uniformity of benefits and targets of 600 plots of land consisting of
transmigration land or agricultural land.
