Aktor non-negara khususnya korporasi telah diletakkan dalam posisi untuk melindungi serta memenuhi hak asasi manusia, urgensi itu muncul dikarenakan sebagian besar kegiatan korporasi dalam berbagai spektrum selalu bersinggungan dengan resiko pelanggaran HAM, khusus nya pelanggaran hak tenaga kerja dan perusakan lingkungan memberikan dampak pada hak-hak dasar lainnya, maka dari itu fokus kajian dan esensi dalam kegiatan perlindungan, penghormatan dan pemulihan HAM dalam kegiatan bisnis di Indonesia semakin penting dilakukan. Penelitian ini membahas pengaturan tanggung jawab korporasi terhadap penghormatan HAM dalam paradigma hukum internasional dan implementasinya di Indonesia, metode penelitian yang digunakan adalah penelitian hukum normatif. Data yang digunakan bersumber dari peraturan-peraturan hukum internasional dan nasional, buku, jurnal, makalah dan artikel berita yang berkaitan dengan topik bahasan yang diolah dengan melakukan studi kepustakaan serta analisis data menggunakan analisis kualitatif. Hasil penelitian menunjukan bahwa pengaturan tanggung jawab korporasi terhadap penghormatan HAM diatur dalam United Nation Guiding Principles on business and human rights yang di muat dalam 3 pilar utama yaitu ‘Protect, Respect and Remedy’ dan telah di implementasikan di indonesia melalui Perpres no.60 tahun 2023, dan pelaksanaanya sendiri terfokus pada dua mekanisme, yaitu pencegahan, dan mitigasi, diutamakan perusahaan untuk dapat memenuhi unsur-unsur atau upaya pencegahan terlebih dahulu, yaitu dengan melaksanakan dokumen komitmen HAM, dan diikuti melaksanakan uji tuntas HAM, dan tidak mengabaikan langkah mitigasi dalam menanggulangi dampak yang akan terjadi. Luthfi Aulia Chandra Non-state actors today have also been recognized as carrying out the allocation of duties in human rights, especially because some of them rival the economic and organizational power of the state, making it possible to intervene in the realization of human rights. Non-state actors, especially corporations, have been put in a position to protect and fulfill human rights, the urgency arises because most corporate activities in various spectrums always intersect with the risk of human rights violations, especially violations of labor rights and environmental destruction that have an impact on other basic rights, that the focus of study and essence in the activities of protection, respect and restoration of human rights in business activities in Indonesia is increasingly important. This research discusses the regulation of corporate responsibility towards respecting human rights in the paradigm of international law and its implementation in Indonesia, the research method used is normative legal research. The data used are sourced from international and national legal regulations, books, journals, papers and news articles related to the topic of discussion which are processed by conducting literature studies and data analysis using qualitative analysis. The results of the study found that the regulation of corporate responsibility to respecting human rights is regulated in the United Nation Guiding Principles on business and human rights which are contained in 3 principles; 'Protect, Respect and Remedy' and have been implemented in Indonesia through Presidential Regulation No. 60 of 2023. The implementation itself focuses on two mechanism, prevention and mitigation, prioritizing companies to be able to fulfill the elements or prevention efforts first, by implementing human rights commitment documents, and followed by carrying out human rights due diligence, and not ignoring mitigation steps in overcoming the impacts that will occur.
