BBL PADA PERAIRAN PROVINSI LAMPUNG
(Studi pada Direktorat Kepolisian Perairan Polda Lampung)

%X kasus tindak pidana yang mengancam kelestarian sumber daya perikanan dan ekosistem laut di Indonesia, termasuk di wilayah perairan Provinsi Lampung. Kerugian dibidang ekonomi ekspor impor juga menjadi salah satu masalah yang besar. Direktorat Kepolisian Perairan (Ditpolair) memiliki peran strategis dalam upaya pemberantasan kejahatan ini melalui berbagai langkah penegakan hukum. Permasalahan dari penelitian ini untuk mengetahui peran Direktorat Kepolisian Peraian (Ditpolair) Polda Lampung dalam memberantas tindak pidana penyelundupan benih bening lobster (BBL) dan apa saja faktor penghambat dari penegakan hukum yang dilakukan Direktorat Kepolisian Perairan (Ditpolair) Polda Lampung.
Pendekatan yang dilakukan dalam penelitian ini adalah pendekatan yuridis empiris kemudian disesuaikan dengan yuridis normatif. Dalam penelitian narasumber terdiri dari anggota Direktorat Kepolisian Perairan dan Udara (Ditpolairud)  Polda Lampung, dan Akademesi Bagian Hukum Pidana Universitas Lampung. Selanjutnya penelitian dianalisis secara kualitatif. 
Hasil penelitian dan pembahasan menunjukkan bahwa Direktorat Kepolisian Perairan (Ditpolair) menjalankan perannya secara  normatif, dan faktual yang dimaksud dalam teori peran penegakan hukum yang dilakukan sesuai dengan Permem KP Nomor 7 Tahun 2024 yang berkaitan dengan pengelolaan benih bening lobster (BBL). Secara Normatif, Ditpolair melakukan perannya di wilayah perairan dengan melakukan patroli, pengawasan, penyidikan, dan penindakan terhadap tindak pidana penyelundupan berdasarkan UU Perikan dan Permen KP Nomor 7 Tahun 2024. Secara Faktual, penegakan hukum yang dilakukan melakukan penyelidikan dan penyidikan tindak pidana penyelundupan benih bening lobster (BBL) yang juga dilakukan secara koordinasi antar instansi seperti Kementerian Kelautan dan Perikanan (KKP), TNI AL, dan Beacukai. Ditpolair dalam menjalankkan tugasnya terdapat hambatan dan tantangan yang menyebabkan belum terlaksananya peran secara ideal dalam tindak pidana penyelundupan BBL.

Saran dari penelitian ini adalah dikarenakan kejahatan tindak pidana penyelundupan benih bening lobster (BBL) para pelaku kejahatan yang tidak bertanggung jawab yang disebabkan oleh faktor eksternal dan internal yang berkaitan dengan preventif, preemtif dan represif. Perlu penguatan kebijakan dalam penanganan kasus tindak pidana penyelundupan benih bening lobster untuk memberikan efek jera kepada pelaku. Peningkatan fasilitas teknologi dalam membantu proses penyidikan dan penyelidikan yang dilakukan Direktorat Kepolisian Perairan (Ditpolair) Polda Lampung, serta sinergi lebih erat antar- lembaga dalam memberantas tindak pidana penyelundupan benih bening lobster (BBL) di perairan provinsi lampung.

Losses in the export and import economy are also one of the big problems. The Directorate of Maritime Police (Ditpolair) has a strategic role in efforts to eradicate this crime through various law enforcement measures. The problem of this study is to find out the role of the Directorate of Maritime Police (Ditpolair) of the Lampung Police in eradicating the crime of smuggling clear lobster seeds (BBL) and what are the inhibiting factors of law enforcement carried out by the Directorate of Maritime Police (Ditpolair) of the Lampung Police.
The approach carried out in this study is an empirical juridical approach and then adjusted to normative juridical approach. In the research, the resource persons consisted of members of the Directorate of Water and Air Police (Ditpolairud) of the Lampung Police, and the Academy of Criminal Law of the University of Lampung. Furthermore, the research was analyzed qualitatively.
Police (Ditpolair) carries out its role normatively, and factually referred to in the theory of the role of law enforcement carried out in accordance with Permem KP Number 7 of 2024 related to the management of clear lobster seeds (BBL). Normatively, the Ditpolair carries out its role in the waters by patrolling, supervising, investigating, and prosecuting smuggling crimes based on the Fisheries Law and the Ministerial Regulation Number 7 of 2024. Factually, law enforcement conducted an investigation and investigation of the crime of smuggling clear lobster seeds (BBL) which was also carried out in coordination between agencies such as the Ministry of Maritime Affairs and Fischeries (KKP), TNI AL, and Beacukai. The Directorate of Police in carrying out its duties has obstacles and challengs that have caused the role of not being carried out ideally in the crime of BBL smuggling.

The suggestion of this study is that due to the crime of smuggling clear lobster seeds (BBL) by irresponsible perpetrators caused by external and internal factors related to preventive, preemptive and repressive. It is necessary to strengthen policies in handling cases of smuggling clear lobster seeds to provide a deterrent effect to the perpetrators. Improvement of technological facilities in assisting the investigation and investigation process carried out by the Directorate of Marine Police (Ditpolair) of the Lampung Police, as well as closer synergy between agencies in eradicating the crime of smuggling clear lobster seeds (BBL) in the waters of Lampung province.
