UDARA INDONESIA (UNDANG – UNDANG NO 1 TAHUN 2009
TENTANG PENERBANGAN)ASEAN akan meliberalisasikan jalur udara melalui ASEAN Open Sky pada akhir
tahun 2015 sebagai wujud dalam merealisasikan program kerja Komunitas
Ekonomi ASEAN 2020. Liberalisasi jalur Udara ASEAN ini juga terinspirasi dari
hasil positif yang dicapai Uni Eropa dan kesatuan Australia/ Selandia Baru
(Oceania) dalam menerapkan Open Sky. ASEAN Open Sky pertama kali
diusulkan pada pertemuan ASEAN Summit ke 5 di Bangkok tahun 1995.
Ketentuan-ketentuan yang ada pada ASEAN Open Sky sendiri memiliki
perbedaan mendasar dengan Undang-Undang Penerbangan Indonesia (Undang-
Undang No 1 Tahun 2009 Tentang Penerbangan) karena Open Sky berideologi
secara liberal.
Pokok permasalahan pada penelitian ini adalah bagaimana kebijakan ASEAN
Open Sky dalam perspektif hukum udara Indonesia (Undang-Undang Nomor 1
Tahun 2009 Tentang Penerbangan).
Penelitian ini menggunakan metode normatif dengan analisis kualitatif yang
kemudian diambil kesimpulan secara induktif.
Berdasarkan hasil penelitian dan pembahasan yang dilakukan oleh penulis,
Ketentuan-ketentuan yang ada pada kebijakan ASEAN Open Sky tidak
bertentangan dengan Undang-Undang Penerbangan Indonesia. Beberapa konsep
ketentuan Open Sky seperti Open Market, Pricing, Optional 7th freedom cargo
right, Cooperative Marketing Arrangement, Safety and Security, Level Playing
Field, Charter Market, dan Dispute Resolution tidak bersinggungan dengan
peraturan penerbangan Indonesia selama ini. Selain itu 3 Perjanjian Multilateral
ASEAN Open Sky juga tidak bertentangan dengan Undang-Undang Nomor 1
Tahun 2009 Tentang Penerbangan. Saran penulis dalam menanggapi kesiapan
Indonesia dalam menghadapi ASEAN Open Sky Indonesia diharuskan melakukan
perbaikan pada kualitas maskapai penerbangan, bandara, dan teknologi udara agar
mampu bersaing dengan negara lain. Selain itu, Indonesia perlu melakukan
pembaharuan peraturan penerbangan agar dapat menyesuaikan diri sebelum
meratifikasi kebijakan ASEAN Open Sky.

ABSTRAK BAHASA INGGRIS
ASEAN will liberalize the air line in the end of 2015 through the ASEAN Open
Sky as a form of realizing the work programs in ASEAN Economic Community
by 2020. Liberalization of ASEAN air line is also inspired by the positive results
achieved by European Union and Australia/ New Zealand unity (Oceania) in
implementing Open Sky policy. ASEAN Open Sky was first proposed at the
meeting of the 5th ASEAN Summit in Bangkok 1995. Existing provisions in the
ASEAN Open Sky itself has fundamental differences with the Indonesian
Aviation Act (Act Number 1 year 2009 about Aviation) as Open Sky has a liberal
ideology
The main issue in this study is how the ASEAN Open Sky Policy in perspective
Indonesian air law (Act Number 1 year 2009 about Aviation ) .
The research using the normative method with used was a qualitative analysis
which is then drawn the conclusions inductively .
Based on the results of research and study conducted by the authors, the existing
provisions in the ASEAN Open Sky policy does not conflict with the Indonesian
Aviation Law. Some provisions of the Open Sky concepts such as Open Market,
Pricing, Optional 7th freedom cargo rights, Cooperative Marketing Arrangements,
Safety and Security, Level Playing Field, Charter Market , and Dispute Resolution
do not intersect with the Indonesian aviation regulations. Besides, 3 ASEAN
Multilateral Agreements on Open Sky are also not contrary to the Act Number. 1
year 2009 about aviation. The Advice from author in response to the readiness of
Indonesia in the ASEAN Open Sky Indonesia are required to make improvements
in quality of airlines, airports , and air technology in order to compete with other
countries. In addition, Indonesia needs to reform the aviation regulation in order
to adapt before ratifying the ASEAN Open Sky Policy.
