Abstrak

ABSTRAK Lampung memiliki jalan lintas Jawa-Sumatera dengan rata-rata konstruksi jalan dibuat dengan muatan sumbu terberat (MST) 8,12 ton. Berdasarkan Peraturan Daerah Nomor 5 Tahun 2011 tentang Pengawasan Angkutan Barang Pemerintah Provinsi Lampung, dalam aturan itu ditetapkan setiap kendaraan yang melebihi toleransi sebesar 5-15% dari Jenis Berat Diizinkan dikenakan denda. Fakta di lapangan kendaraan bermuatan mencapai 20 ton bebas lalu lalang di Lampung. Akibatnya, jalan darat rusak lebih cepat dibandingkan usia efektifnya. Jembatan Timbang seharusnya difungsikan dengan baik. Permasalahan dalam penelitian ini yaitu, Bagaimana pengaturan hukum tentang kedudukan dan kontribusi uang denda kelebihan tonase pada pendapatan asli daerah Provinsi Lampung? Bagaimana pelaksanaan dan pengawasan pemungutan uang denda kelebihan tonase pada jembatan timbang Lampung Selatan? Pendekatan masalah dalam penelitian ini menggunakan pendekatan normatif dan pendekatan empiris. Sumber data dalam penelitian ini yaitu bahan hukum primer dan bahan hukum sekunder. Prosedur pengumpulan data, yaitu studi kepustakaan dan studi lapangan. Selanjutnya, pengolahan data dengan cara seleksi data, pemeriksaan data, klasifikasi data, dan penyusunan data. Hasil penelitian dan pembahasan adalah: Pengaturan hukum tentang kedudukan dan kontribusi uang denda kelebihan tonase pada dasarnya telah memenuhi kebutuhan pengendalian kelebihan muatan angkutan barang pada lalu lintas dan angkutan jalan. Namun, pelaksanaannya belum sepenuhnya berjalan dengan benar sesuai ketentuan yang berlaku. Pelaksanaan dan pengawasan pemungutan uang denda kelebihan tonase dilakukan melalui unit penimbangan dan/atau pembatasan lalu lintas mobil barang pada koridor atau kawasan tertentu pada ruas jalan provinsi. The Problems in this research were how was the law regulation on the status and contribution of tonnage excess money fines against the local revenues of Lampung Province? How was the implementation and supervision of excess tonnage money fines collection in South Lampung weighbridge? The approaches used in this research were normative and empirical approach. The data sources in this research were primary and secondary legal materials. Data collection procedures were literature and field study. Furthermore, the data processed through data selection, data examination, data classification, and data preparation. The result of the research showed that the law regulation on the status and contribution of excess tonnage money fines basically has met the needs of controlling overloading of freight on traffic and road transport. However, the implementation has not been fully run properly according to applicable regulations. Implementation and supervision of excess tonnage money fines collection carried through the weighing unit and / or restrictions on car traffic of goods in the corridor or a specific area on the provincial road.
