Abstrak

Abstrak Pengadaan tanah untuk keperluan pembangunan Jalan Lintas Pantai Timur Ruas Jalan Way Jepara-Way Sekampung/Bunut di Kabupaten Lampung Timur berjalan tidak seperti yang diharapkan karena pelaksanaan pengadaan tanah yang dimulai sejak tahun 2008 belum terselesaikan disebabkan besaran ganti rugi ditolak oleh warga pemilik lahan sehingga harus dimediasi oleh Ombudsman Republik Indonesia. Oleh karena itu, permasalahan yang diangkat peneliti adalah bagaimana implementasi kebijakan Pengadaan Tanah tersebut. Tujuan penelitian ini adalah untuk mengetahui implementasi kebijakan Pengadaan Tanah Untuk Pembangunan Jalan Lintas Pantai Timur Ruas Jalan Way Jepara – Way Sekampung / Bunut Kabupaten Lampung Timur. Metode penelitian yang digunakan adalah jenis penelitian kualitatif dengan pendekatan deskriptif melalui wawancara dan dokumentasi, dengan fokus penelitian pada implementasi kebijakan pengadaan tanah ditinjau dari variabel : komunikasi, sumber daya, disposisi, struktur birokrasi dan lingkungan kebijakan.Hasil penelitian ini menunjukan bahwa implementasi kebijakan Pengadaan Tanah Untuk Pembangunan Jalan Lintas Pantai Timur Ruas Jalan Way Jepara – Way Sekampung/Bunut Kabupaten Lampung Timur sangat dipengaruhi oleh kelima variabel dalam fokus penelitian yaitu komunikasi, sumber daya, disposisi, struktur birokrasi dan lingkungan kebijakan. Komunikasi dapat dilakukan secara efektif oleh Panitia Pengadaan Tanah Kabupaten Lampung Timur dengan SNVT Pelaksana Jalan Nasional Wilayah I Provinsi Lampung selaku pihak yang memerlukan tanah dan Warga Pemilik Lahan. Kemampuan implementator dalam menguasai kebijakan pengadaan tanah cukup baik hanya saja kurang didukung oleh ketersediaan dana dan prasarana yang memadai. Disposisi implementator pun cukup baik yaitu selalu berupaya melaksanakan tahapan pengadaan tanah sesuai peraturan yang berlaku dengan menunjuk lembaga penilai yang berkompeten dalam menentukan besaran nilai ganti rugi dan selalu bermusyawarah dengan pihak-pihak terkait apabila ada kendala. Pelaksanaan pengadaan tanah untuk pembangunan Jalinpantim tidak memiliki standar operating procedur (SOP) khusus, tahapan-tahapan dilaksanakan mengacu pada peraturan yang ada yaitu Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 3 Tahun 2007 dengan pembagian kewenangan sesuai dengan tugas pokok masing-masing instansi. Implementasi kebijakan pengadaan tanah ini sangat dipengaruhi oleh lingkungan kebijakan yaitu adanya Surat Edaran Gubernur yang menyatakan bahwa tanah tidak diganti rugi dan adanya fasilitasi oleh Ombudsman Republik Indonesia dalam menyelesaikan kendala-kendala yang dihadapi saat pelaksanaan pengadaan tanah. Abstract Land providing for Wast Coast road development from Way Jepara to Way Sekampung/Bunut in East Lampung district did not run as it was expected, because the land providing conducted from 2008 was not yet finished because the sum of compensation was refused by land owners so that the conflict should be mediated by Ombudsman of Republic of Indonesia. The problem of this research was how did the implementation of land providing policy. The objective of this research was to find out the implementation of land providing policy for East Coast road development from Way Jepara to Way Sekampung/Bunut of East Lampung district. This was a qualitative research with descriptive approach. Data were collected with interviews and documentation, and research focus was the implementation of land providing policy viewed from variables of communication, resource, disposition, bureaucracy structure, and policy environment. The result showed that the implementation of land providing for East Coast road development from Way Jepara to Way Sekampung/Bunut in East Lampung district was influenced by five variables in the research focus; they were communication, resource, disposition, bureaucracy structure, and policy environment. Communication could be done effectively between Committee of Land Providing in East Lampung with SNVT of National Road Implementer of Region I in Lampung province as the party required the land and residents as land owners. The ability of implementer in understanding land providing policy was good but lacking of sufficient available fund and structure supports. Disposition of implementer was good by always making efforts to conduct stages in land providing according to prevailing regulations by appointing competent assessor agency to determine the amount of compensation and by discussion for deliberation with related parties for problem solutions. The exercise of land providing for East Coast road development did not have a special standard operating procedure (SOP). The procedure stages were conducted by referring to prevailing regulations including the Regulation of Head of National Land Agency of Republic of Indonesia number 3 in 2007 by distributing authorities according to job descriptions of related institutions. The implementation of land providing policy is influenced by policy environment in form of Official Letter of Governor stating that the lands for road development were not compensated and the mediation of Ombudsman of Republic of Indonesia in overcoming problems faced at the land providing processes.
