Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
ABSTRAK Di Provinsi Lampung, terdapat Kawasan Hutan Produksi yang Dapat Dikonversi (HPK) berdasarkan Surat Keputusan Menteri Kehutanan dan Perkebunan Nomor 416/Kpts-II/1999 adalah seluas +153.459 hektar atau 17,42% dari seluruh Kawasan Hutan Produksi yang Dapat Dikonversi (HPK) tersebut. Seluas + 145.125 hektar atau 17.2% dari luas HPK, secara de facto sudah diokupasi masyarakat menjadi pemukiman/perumahan, fasilitas sosial dan fasilitas umum yang tidak memiliki jaminan kepastian hukum dan pemanfaatan serta penguasaan areal tanah dimaksud mengakibatkan berubahnya fungsi kawasan hutan dan rusaknya kawasan hutan. Dalam rangka memenuhi aspirasi masyarakat yang selama ini memanfaatkan dan menguasai secara fisik tanah eks HPK, Pemerintah Daerah mengusulkan pelepasan kawasan HPK kepada Menteri Kehutanan dan Perkebunan dengan keputusannya nomor 256/Kpts-II/2000. Dengan disetujuinya pelepasan kawasan hutan, maka kawasan tersebut yang semula berstatus sebagai kawasan HPK menjadi kawasan bukan HPK yang pengaturan tata ruang/tata guna tanah eks kawasan HPK tersebut menjadi kewenangan Gubernur. Oleh karenanya untuk pelaksanaan pemberian hak atas tanah yang akan diberikan kepada masyarakat tersebut, dikeluarkanlah Peraturan Daerah Provinsi Lampung Nomor 6 Tahun 2001 tentang Alih Fungsi Lahan Dari Kawasan Hutan Produksi Yang Dapat Dikonversi (HPK) seluas 145.125 Hektar Menjadi Kawasan Bukan HPK dalam Rangka Pemberian Hak Atas Tanah. Permasalahan yang akan diteliti mulai dari pemberian hak atas tanah sampai faktor-faktor yang menjadi pendukung dan penghambat dalam pelaksanaan pemberian hak atas tanah kepada Masyarakat di Eks Kawasan Hutan Produksi Kecamatan Bengkunat Kabupaten Pesisir Barat. Pendekatan masalah yang dilakukan dalam penelitian ini adalah pendekatan normatif dan pendekatan empiris. Pengumpulan data dilakukan dengan menggunakan data primer yang dikumpulkan melalui studi lapangan yakni wawancara, dan data sekunder menggunakan metode kepustakaan. Berdasarkan hasil penelitian dapat diketahui bahwa pelaksanan pemberian hak atas tanah oleh Kantor Pertanaha Kabupaten Lampung Barat kepada masyarakat di eks Kawasan Hutan Produksi Kecamatan Bengkunat Kabupaten Pesisir Barat dilakukan secara missal melalui Prona Swadaya sejak tahun 2004, dengan dasar Surat Keputusan Menhutbun No. 256/Kpts-II/2000 tentang penunjukan kawasan hutan dan perairan di wilayah Propinsi Lampung. Faktor pendukungnya adalah adanya program pemerintah untuk melaksanakan pendaftaran tanah secara sistematik di Kecamatan Bengkunat adalah meningkatkan pemasukan ke kas negara dan pemberian hak atas tanah, dan besarnya keinginan masyarakat untuk mendapatkan jaminan kepastian hukum pertanahannya. Faktor penghambatnya adalah sebagian besar masyarakat yang menempati tanah eks kawasan HPK Kecamatan Bengkunat Kabupaten Pesisir Barat tidak mempunyai bukti penguasaan tanah yang jelas, dan penetapan batas yang jelas. Therefore, for the implementation of granting land rights to be granted to these communities, was issued Provincial Regulation Lampung No. 6 of 2001 on Transfer Function of Land Of Forest Area Production Convertible covering an area of 145 125 hectares Being Region Not HPK in Order Granting Rights Land. Issues that will be examined ranging from land titling to the factors supporting and inhibiting the implementation of granting land rights to the Community in Ex Production Forest Area at Bengkunat District of Pesisir Barat Regency. Approach the problem in this research is normative approaches and empirical approach. Data collected by using primary data collected through field studies that interview, and secondary data using the method of literature. Based on the results of this research is that the conduct of land titling by the Office Pertanaha West Lampung district to the public in the former Production Forest District on Bengkunat District of Pesisir Barat Regency done eg through Prona Organization since 2004, on the basis of Decree No. Menhutbun 256 / Kpts-II / 2000 on the designation of forests and waters in Province of Lampung. Supporting factor is the existence of government programs to implement systematic land registration in Bengkunat is to increase revenue to the state treasury and the issuance of land titles, and the magnitude of people's desire to obtain legal certainty pertanahannya. Inhibiting factor is the majority of the people who occupy the land of the former Convertible Production Forest on Bengkunat District of Pesisir Barat Regency does not have clear proof of land ownership, and the establishment of clear boundaries.
