ABSTRAK PERAN KEPOLISIAN DALAM MENANGGULANGI TINGGINYA TINGKAT KECELAKAAN LALU LINTAS DI JALAN RAYA TERHADAP PENGENDARA YANG TIDAK MEMILIKI SURAT IZIN MENGEMUDI (SIM) (Studi Di Polresta Bandar Lampung) Oleh Rainah Lalu lintas merupakan salah satu sarana penting bagi masyarakat untuk memperlancar aktivitas yang dilakukan. Selain berguna untuk memperlancar aktivitas, tidak bisa kita pungkiri bahwa lalu lintas pun dapat mengakibatkan kerugian yang sangat besar bagi kita seperti kecelakaan. Kecelakaan yang disebabkan oleh faktor pengendara sendiri antara lain disebabkan karena pengendara yang tidak disiplin, juga karena adanya pengendara yang berusia di bawah tujuh belas tahun yang mengendarai tanpa dilengkapi SIM. Permasalahan yang dibahas penulis dalam skripsi ini yaitu bagaimanakah peran Satlantas Polresta Bandar Lampung dalam menanggulangi tingginya tingkat kecelakaan lalu lintas terhadap pengendara yang tidak memiliki SIM dan apa faktor yang menjadi penghambat dan pendukung peran Satlantas Polresta Bandar Lampung dalam menanggulangi tingginya tingkat kecelakaan lalu lintas terhadap pengendara yang tidak memiliki SIM. Pendekatan masalah yang dipergunakan dalam penulisan ini adalah pendekatan yuridis normatif dan pendekatan yuridis empiris dengan data primer dan data sekunder. Sumber data primer yaitu diperoleh langsung dari penelitian di Kepolisian Polresta Kota Bandar Lampung, data sekunder yaitu bahan-bahan yang memberikan petunjuk dari penjelasan terhadap bahan hukum primer dan bahan hukum tersier yaitu bahan hukum yang dapat membantu pemahaman dalam menganalisa serta memahami permasalahan, seperti literatur hukum, kamus hukum dan sumber lain yang sesuai. Berdasarkan hasil penelitian yang dilakukan penulis yakni peran kepolisian dalam menggulangi tingginya tingkat kecelakaan lalu lintas terhadap pengendara yang tidak memiliki SIM diatur dengan Undang-Undang Nomor 2 Tahun 2002 Tentang Kepolisian Republik Indonesia menjelaskan bahwa, dalam Pasal 5 ayat (1), peran kepolisian merupakan alat Negara yang berperan untuk memelihara keamanan dan ketertiban masyarakat, menegakkan hukum, serta memberikan perlindungan, pengayoman, dan pelayanan kepada masyarakat. Peran dalam pelaksanaannya Satlantas Polresta Bandar Lampung dalam menanggulangi tingginya tingkat kecelakaan lalu lintas di jalan raya terhadap pengendara yang tidak memiliki SIM, belum baik pelaksanaannya. Hal ini telah terbukti dengan meningkat angka kecelakaan lalu lintas di jalan raya Kota Bandar Lampung yang dari tahun 2012-2013. Berdasarkan kutipan di atas, penulis menyarankan agar: (1) Aparat Satlantas Polresta Bandar Lampung harus meningkatkan lagi dalam melakukan pengawasan berlalu lintas di jalan raya dan melakukan razia-razia rutin kepada pengendara yang mengendarai kendaraannya. (2) Kepada Pemerintah Kota Bandar Lampung ataupun pihak yang terkait, agar sarana, prasaranan lalu lintas dapat di perbaiki demi kenyamanan dan keselamatan berkendaraan. (3) Perlu adanya kesadaran dari setiap masyarakat agar untuk taat pada hukum dan aturan yang berlaku agar tingkat pelanggaran lalu lintas yang mengakibatkan kecelakaan dapat berkurang serta kesadaran masyarakat untuk menghormati aparat yang sedang bertugas karena dengan adanya hubungan harmonis antara masyarakat dan aparat kepolisian dapat lebih efektif dan efisien. Kata Kunci :Peran Kepolisian, Kecelakaan Lalu Lintas, Pengendara Tidak Memiliki SIM ABSTRACT THE ROLE OF POLICE IN PREVENTING THE HIGH RATE OF TRAFFIC ACCIDENT ON HIGHWAY TOWARDS THE RIDER THAT DOES NOT HAVE A DRIVING LICENSE (SIM) (Studies In Bandar Lampung Police Department) by RAINAH Traffic is one of the important means for the public to facilitate the activities that undertaken. Besides it is useful to facilitate the activity, we can not deny that any traffic can cause in huge losses for us, such as an accident. Accidents caused by riders themselves among other factors are caused by riders who are not disciplined, also because of the under-seventeen riders of who drive without the necessary license. The problems discussed by the author in this thesis were on how the Police Traffic Unit's role in Bandar Lampung overcame the high rate of traffic accidents on rider who doesn’t have a driver's license and what were the inhibiting and supporting factors of the role of Police Traffic Unit's in overcoming the high rate of traffic accidents to rider who does not have a driver's license. The problem approach used in this paper was normative juridical and judicial empirical approach with the primary data and secondary data. The primary data sources were obtained directly from research in Bandar Lampung Police Department, secondary data were the materials that provide the guidance for the explanation of primary legal materials and tertiary legal materials that could assist in the understanding of analysis and understanding the issues, such as legal literature, legal dictionaries and other appropriate sources. Based on the results of the research by the authors, it could be understood that the role of the police in overcoming the high rate of traffic accidents on the rider who doesn’t not have a license was regulated by Act No. 2 year 2002 on the Indonesian National Police that explained, under Article 5, paragraph (1), the role of the police was a mean of state whose role was to maintain security and public order, enforce the law, as well as provide protection, guidance, and service to the society. In the implemantation, The Role of Police Traffic Unit in overcoming the high rate of traffic accidents on the highway on rider who doesn’t not have a driver's license was good enough and ideal in implementation and the application of sanctions given to the perpetrators of road accidents has been regulated. This has been proved by the decreasing number of traffic accidents on the highway from the city of Bandar Lampung in 2012-2013 and in accordance with the duties regulated in the legislation. Based on the quote above, the author suggested that: (1) Police Traffic Unit officers of Bandar Lampung must increase the monitoring of traffic on the highway, especially on rider who doesn’t not have a driver's license. (2) To the Government of Bandar Lampung or related parties, the infrastructure of traffic can be improved for the sake of convenience and driving safety. (3) It is needed that the existence of awareness from the people to obey the applicable laws and rules so that the rate of traffic violations that lead to accidents can be reduced, and public awareness to respect the officers-on-duty, with a harmonious relationship between the society and police apparatus can be more effectively and efficiently.
