PELAKSANAAN CSR DALAM BENTUK PROGRAM KEMITRAAN DAN BINA LINGKUNGAN SEBAGAI WUJUD TANGGUNG JAWAB EKSTERNAL PERUSAHAAN DI PTPN VII (PERSERO) Praktik Tanggung Jawab Sosial Perusahaan (TJSP) yang diimplementasikan dalam bentuk Corporate Social Responsibility (CSR) atau Tanggung Jawab Sosial dan Lingkungan (TJSL) di Indonesia dalam peraturan perundang-undangan merupakan salah satu kewajiban yang harus dilaksanakan oleh perusahaan sesuai dengan isi Pasal 74 Undang-Undang Perseroan Terbatas (UUPT) No. 40 Tahun 2007 yang merupakan lex generalis atas semua Perseroan yang menjalankan kegiatan usahanya di bidang dan / atau berkaitan dengan sumber daya alam dengan tujuan upaya meningkatkan kepedulian kualitas kehidupan, harmonisasi sosial dan lingkungan. Pelaksanaan TJSL di perusahaan BUMN merupakan lex special (special law) dan aturan wajib yang diatur dalam UU BUMN No. 19 Tahun 2003 Pasal 2 ayat (1) huruf e, yang menyebutkan bahwa salah satu maksud dan tujuan pendirian BUMN adalah turut aktif memberikan bimbingan dan bantuan kepada pengusaha golongan lemah, koperasi, dan masyarakat. Selanjutnya dalam Pasal 88 ayat (1) UU BUMN tersebut disebutkan bahwa BUMN dapat menyisihkan sebagian laba bersihnya untuk keperluan pembinaan usaha kecil dan koperasi serta pembinaan masyarakat sekitar BUMN. Permasalahan dalam tesis ini adalah Bagaimana pelaksanaan CSR di PTPN VII (Persero) sebagai wujud tanggung jawab eksternal dalam bentuk Program Kemitraan dan Bina Lingkungan, yang selama ini diberlakukan secara sukarela (voluntary) menjadi diatur secara wajib (mandatory) dikaitkan pada Pasal 74 UUPT No. 40 Tahun 2007 dan Bagaimana penerapan sanksi hukum atas pelaksanaan CSR pada PTPN VII (Persero) sebagai tanggung jawab eksternal perusahaan terkait Pasal 74 ayat (3) UUPT Tahun 2007. Jenis penelitian ini yuridis empiris yaitu penelitian terhadap efektivitas hukum, yang membahas bagaimana hukum beroperasi dalam masyarakat. Tipe penelitian dalam penulisan tesis ini bersifat penelitian deskriptif analisis yaitu menganalisa data yang dipergunakan baik data primer dan data sekunder. Metode analisa data menggunakan deduktif yaitu penarikan kesimpulan secara menyeluruh dengan suatu metode dari hal-hal yang bersifat umum menuju penulisan yang bersifat khusus. Berdasarkan hasil penelitian diketahui bahwa implementasi CSR yang dilakukan PTPN VII (Persero) walaupun diatur secara mandatory oleh perundang-undangan berupa PKBL dan CSR/Community Development masih bersifat philanthropy, sehingga belum memberikan dampak yang baik bagi masyarakat di sekitarnya. Pengaturan tentang CSR dalam UUPT, UU BUMN, dan Permenneg BUMN bersifat mandatory, ada kekuatan memaksa namun belum terdapatnya sanksi. Kata Kunci : Corporate Social Responsibility, Stakeholder dan BUMN THE ENFORCEMENT OF CSR IN ORDER PARTNERSHIP PROGRAMME AND BUILDING ENVIRONMENT AS A IMPLEMENTATION OF THE COMPANY EXTERNAL RESPONSIBILITY IN PTPN VII (PERSERO) The Practice of Environment Social Responsibility (Praktik Tanggung Jawab Sosial Lingkungan/TJSL), the implementation of Corporate Social Responsiility (CSR) in Indonesia legislation, is one of the obligation in company that appropriate with the content of the new Undang-Undang (UUPT)/company regulation, in article 74 UU No. 40, 2007 as a lex generalis for all company that run the activities in related sectors with sources in aim to improve the concern of life quality, social harmony and the environment. The implementation of TJSL in BUMN company as a lex special (special law) due to the rules in UU BUMN NO. 19, 2003 article 2 verse (1) letter e, mentioned, the aim and objectives BUMN is a participate to give the direction and the assistance for the poor section enterpreneurs, cooperative and society. Furthermore, in article 88, verse (1) UU BUMN mentioned the ability of BUMN to partially eliminate the profit for the requirements of small business and cooperative, including the direction in society around BUMN. The issue in this thesis is How the implementation of CSR in PTPN VII (Persero) as a form of responsibility external in Partnership Programme and Building Environment within have been applied as a voluntary that become arranged to a mandatory in article 74 UUPT NO. 40, 2007 and How the application of law sanctions for the enforcement CSR in PTPN VII (Persero) as a Responsibility of The Company External related to article 74, verse (3) UUPT, 2007. The kind of this research is juridical and empirical, that towards to the law activities, discuss how to operate the law into society. The type of research in this thesis tend to descriptive analyze means to analyze all datas either in primary and secondary. The method of the analize data using the deductive as a conclusion in all with one method from the generally concern become a specific concern. Regarding to the result of research, discovered that the implementation of CSR in PTPN VII (Persero) although arranged in mandatory way by legislation such as PKBL and CSR/ Community Development remain philanthropy, yet give the good impact to the society. The adjustment of CSR in UUPT, UU BUMN, and Permenneg BUMN refer to mandatory, there is a force power, however has no yet sanctions inside.
