ABSTRAK Analisis Perlindungan Hukum Bagi Korban Penipuan Jual Beli Online Oleh Fabiandi Cornelis Jual beli melalui media internet saat ini sering dilakukan oleh masyarakat di Indonesia terkadang menimbulkan fenomena kejahatan cybercrime seperti penipuan, sehingga diperlukan perlindungan hukum secara khusus bagi korban penipuan jual beli online. Permasalahan dalam penelitian ini yaitu bagaimanakah perlindungan hukum bagi korban penipuan jual beli online? dan apa saja faktor yang mempengaruhi perlindungan hukum bagi korban penipuan jual beli online? Metode penelitian yang digunakan melalui pendekatan yuridis normatif dan yuridis empiris. Data dikumpulkan melalui studi kepustakaan dan studi lapangan. Narasumber dalam penelitian ini meliputi Penyidik pada Kepolisian Resor Kota Bandar Lampung, Jaksa pada Kejaksaan Negeri Bandar Lampung, dan Hakim pada Pengadilan Negeri Kelas IA Tanjungkarang. Hasil penelitian dan pembahasan dapat disimpulkan bahwa perlindungan hukum terhadap korban tindak pidana jual beli online pada dasarnya dilakukan melalui upaya penal dan non penal. Upaya penal dapat ditempuh melalui upaya represif, sedangkan non penal ditempuh melalui jalur preventif. Upaya represif dilakukan dengan cara yaitu korban dapat melaporkan tindak pidana penipuan dengan cara mendatangi instansi penegak hukum untuk di proses lebih lanjut. Selanjutnya upaya preventif dilakukan dengan memberikan sosialisasi peraturan perundang-undangan dan penyuluhan hukum terkait penggunaan teknologi serta budaya untuk tidak merespon terhadap permintaan informasi pribadi lewat e-mail. Faktor yang mempengaruhi perlindungan bagi korban penipuan jual beli online terfokus pada minimnya sarana dan prasarana yang memadai, belum maksimalnya sosialisasi peraturan perundang-undangan terkait tindak pidana cybercrime kepada masyarakat, kualitas sumberdaya aparat penegak hukum serta kultur masyarakat yang enggan untuk memberikan laporan dan kesaksian. Saran yang disampaikan yaitu Pemerintah Republik Indonesia hendaknya mengikutsertakan aparat penegak hukum dalam kegiatan pendidikan dan pelatihan secara khusus untuk meningkatkan kualitas dan kemampuan bagi aparat penegak hukum dalam mengungkap kasus-kasus cybercrime. Kata Kunci : Perlindungan Hukum, Korban Penipuan, Jual Beli Online ABSTRACT Analysis Of Legal Protection For Sale Online Fraud Victim by Fabiandi Cornelis The buying and selling through the internet is now often done by people in Indonesia sometimes rise to the phenomenon of cyber crime crimes such as fraud, thus requiring special legal protection for victims of fraud and selling online. The problem in this study is how the legal protection for victims of fraud online purchase? and what are the factors that affect the legal protection for victims of fraud online purchase? The method used by juridical normative and empirical. Data were collected through library research and field study. Informants in this study included investigators at Bandar Lampung Police, Attorney at Bandar Lampung District Attorney, and District Court Judge in Class IA Tanjungkarang. The results of this study concluded that the legal protection of victims of crime and selling online is basically done through the efforts of the penal and non-penal. Efforts can be reached through the efforts of penal repression, while the non-penal reached by preventive. Repressive efforts done by that victim of criminal fraud can be reported by visiting the law enforcement agency for further proceedings. Further preventive measures carried out by providing socialization of legislation and legal counseling related to the use of technology and culture did not respond to requests for personal information via e-mail. Factors affecting the protection of victims of fraud online trading focused on the lack of adequate infrastructure, not maximal dissemination of laws and regulations related to the crime of cyber crime to the community, the quality of law enforcement resources and the culture of the people who are reluctant to provide reports and testimony. The suggestions submitted that the Government of the Republic of Indonesia should include law enforcement officers in the education and training specifically to improve the quality and the capability for law enforcement agencies in exposing cases of cyber crime.
