Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
ABSTRAK Pelanggaran hak asasi manusia kini menjadi persoalan penting yang harus segera dibenahi dan segera diselesaikan oleh pemerintah. Pada kasus pelanggaran HAM PT BSMI terhadap masyarakat Desa Sritanjung, Kagungan Dalam dan Nipah Kuning Kabupaten Mesuji, berawal dari HGU yang dimiliki PT BSMI untuk mengelola tanah warga. Minimnya pengelolaan sumber daya alam yang sesuai dengan AMDAL sehingga masyarakat merasa menderita selama 17 tahun. Selain itu, PT BSMI tidak melakukan realisasi atas perjanjian plasma dan kesejahteraan masyarakat. Bahkan perusahaan menempatkan aparat keamanan negara yang dilengkapi persenjataan, terjadi konflik yang berujung pada kematian satu orang masyarakat Kagungan Dalam pada tanggal 10 November 2011. Penelitian ini bersifat deskriptif dengan menggunakan metode kualitatif. Hasilnya menerangkan bahwa konflik ini menimbulkan analisa tiga aspek secara mendasar yaitu agraria, sosial dan manajemen. Dari ketiga aspek tersebut dikaitkan dengan fakta dan realita terhadap Kesenjangan yang terjadi dilingkungan masyarakat, baik secara vertikal dan horizontal bahkan dengan skema segitiga keterkaitan antara Pemerintah, perusahaan dan masyarakat. Hal tersebutlah kemudian memunculkan dua aspek penting melalui pendekatan HAM dan pendekatan lingkungan. Ada dua hal penting yang dihasilkan dalam penelitian ini, pertama proses konflik atau penyebab konflik sehingga memunculkan isu HAM antara lain: (1) Kurang tegasnya pemerintah dalam penentuan batas kewenangan pengelolalaan lahan, (2) Perusahaan Mengabaikan pejanjian RKL, RPL dalam dokumen Amdal, (3) Pemahaman dan kepastian tentang Hukum atau aturan berbeda, (4) Prilaku arogansi aparat keamanan, (5) Kendala Daerah Otonami Baru (DOB) Kabupaten Mesuji, dan (6) Pendidikan dan ekonomi masyarakat miskin. Kedua, penelitian ini menghasilkan bagaimana peran pemerintah dalam upaya penegakkan HAM antara lain: (1) Peran Kesbangpol, (2) Peran pengawasan pemerintah terhadap perlakuan buruh, (3) Peran pemerintah dalam melakukan pembinaan terhadap perusahaan dan masyarakat, serta (4) Proses Regulasi ditolak masyarakat. In the case of human rights violations against the villagers PT.BSMI Sritanjung, Kagungan Dalam and Nipah Kuning Mesuji District, originated from concession (HGU) owned by PT BSMI to manage land residents. The lack of natural resources management in accordance with the AMDAL so that people feel miserable for 17 years. In addition, PT. BSMI not do realization of agreement plasma and welfare of the community. In fact, the company put the state security apparatus equipped weapons coming into conflict that led to the death of one person in the community Kagungan on November 10, 2011. This is a descriptive study using qualitative methods. The results explain that this conflict raises a fundamental analysis of three aspects, namely Agricultural, Social and Management. Of the three aspects are linked to the facts and reality of the gaps that occur within the community, both vertically and horizontally even with triangular scheme linkages between government, companies and society. This is exactly then raises two important aspects of the human rights approach and the environmental approach. Two important things produced in this study, the first cause of the conflict or conflicts that led to the issue of human rights, among others: (1) Less specifically the government in determining the boundaries of land pengelolalaan authority, (2) the Company Ignoring pejanjian RKL, RPL in the AMDAL documents, (3) understanding and certainty about the law or the rules are different, (4) Behaviour arrogance of the security forces, (5) New Otonami Regional Constraints (DOB) Mesuji District, and (6) Education and the poor economy. Second, this study resulted in the role of government in efforts to enforce human rights, among others: (1) Role Kesbangpol, (2) the role of government oversight of the treatment of workers, (3) The role of government in fostering the company and the community, and (4) Regulatory Process rejected society.
