Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Badan Penyelenggara Jaminan Sosial (BPJS) memiliki Program Jaminan Hari Tua (JHT) yang bermanfaat untuk menjamin pekerja untuk menerima uang tunai ketika memasuki masa pensiun, mengalami cacat total dan meninggal dunia. Akan tetapi, pada penerapannya meskipun mengalami kondisi tersebut, pencairan JHT terdapat kendala ketika akan mencairkan uang tersebut. Tujuan penelitian ini adalah mengetahui penerapan program JHT dan faktor penghambat dalam menerapkan program JHT tersebut. Penelitian ini merupakan jenis penelitian Yuridis Normatif dan Yuridis Empiris. Penelitian Yuridis Normatif dilakukan dengan berdasarkan bahan hukum seperti teori hukum, asas-asas hukum serta perundang-undangan yang berhubungan dengan penelitian. Sedangkan, Yuridis Empiris dilakukan dengan wawancara. Analisis yang digunakan adalah Kualitatif. Hasil penelitian ini menunjukan: (1) Penerapan JHT telah dilaksanakan sesuai dengan Peraturan Pemerintah Nomor 46 Tahun 2015 tentang Penyelenggaraan Program Jaminan Hari Tua. Pada Pasal 22 JHT dinyatakan bahwa JHT dapat dicairkan ketika memenuhi persyaratan dengan masa kepesertaan minimal 10 tahun. Namun kenyataannya hal tersebut menuai pro kontra karena JHT baru dapat dicairkan ketika usia 56 tahun. Sehingga, hal ini dapat merugikan peserta JHT yang belum berusia 56 tahun, Tetapi perlu mencacirkan dana segera. (2) Faktor- faktor yang menghambat Penerapan JHT adalah Kendala administratif dalam proses pendaftaran dan kesadaran pengetahuan masyarakat mengenai JHT. Oleh karena itu, hendaknya BPJS memperbaiki sistem JHT dan melakukan sosialisasi untuk mengatasi minimnya infromasi terkait pencairan JHT. Kata Kunci: Program Jaminan Hari Tua, BPJS Ketenagakerjaan, Kota Bandar Lampung. The Social Security Organizing Agency (BPJS) has an Old Age Insurance Program (JHT) which is useful for guaranteeing workers to receive cash when entering retirement, experiencing total disability and death. However, in its application despite experiencing these conditions, JHT disbursement has obstacles when disbursing the money. The purpose of this study is to determine the application of the JHT program and the inhibiting factors in implementing the JHT program. This research is a type of Normative Juridical and Empirical Juridical research. Normative Juridical research is carried out based on legal materials such as legal theory, legal principles and legislation related to research. Meanwhile, Empirical Juridical is conducted by interview. The analysis used is Qualitative. The results of this research show: (1) The implementation of JHT has been implemented in accordance with Government Regulation Number 46 of 2015 concerning the Implementation of the Old Age Security Program. Article 22 states that JHT can be withdrawn when fulfilling the requirements with a minimum participation period of 10 years. However, in reality, this has generated pros and cons because JHT can only be cashed out at the age of 56. So, this can be detrimental to JHT participants who are not yet 56 years old, but need to withdraw funds immediately. (2) Factors that hinder the implementation of JHT are administrative constraints in the registration process and awareness of public knowledge about JHT. Therefore, BPJS should improve the JHT system and conduct socialisation to overcome the lack of information related to JHT disbursement.
