Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Abstrak Dalam rangka mengawasi keselamatan dan kesehatan kerja yang ada, maka pemerintah mengupayakan adanya suatu peran khusus yang diberikan kepada pegawai pengawas ketenagakerjaan untuk mengawasi keselamatan dan kesehatan kerja. Tertera dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dalam Pasal 86 ayat (1) dan ayat (2) yang berbunyi : Ayat (1) setiap pekerja/buruh mempunyai hak untuk memperoleh perlindungan atas keselamatan dan kesehatan kerja, moral dan kesusilaan dan perlakuan yang sesuai dengan harkat martabat manusia serta nilai-nilai agama. Ayat (2) untuk melindungi keselamatan pekerja/buruh guna mewujudkan produktivitas kerja yang optimal diselengarakan upayah keselamataan dan kesehatan kerja. Keselamatan dan kesehatan kerja penting untuk diperhatikan maka pemerintah mengupayakan adanya peran serta efektif dalam rangka pengawasan dalam pengawasan, penerapan serta menindak perusahaan swasta maupun pemerintah dalam pengawasan keselamatan dan kesehatan kerja. Permasalahan dalam penelitian ini adalah bagaimana peran serta faktor penghambat pegawai pengawas ketenagakerjaan dalam melaksanakan pengawasan keselamatan dan kesehatan kerja di Provinsi Lampung. Pendekatan dalam penelitian yaitu pendekatan normatif empiris. Sumber data yang digunakan adalah data primer dan skunder yang dilakukan dengan studi pustaka dan lapangan. Berdasarkan hasil penelitian, diketahui peran pegawai pengawas ketenagakerjaan yaitu melaksanakan norma keselamatan dan kesehatan kerja, serta yang menjadi faktor-faktor penghambatnya yaitu : belum semua perusahaan memiliki panitia pembina keselamatan dan kesehatan kerja (P2K3), ada perusahaan yang belum melaksanakan atau menerapkan keselamatan dan kesehatan kerja di tempat kerja, ada perusahaan belum mengerti arti penting keselamatan dan kesehatan kerja, ada perusahaan yang belum memiliki ahli keselamatan dan kesehatan kerja, tidak sesuainya jumlah pegawai pengawas dengan perusahaan di provinsi Lampung, kurang tegasnya sanksi terhadap pelangaran keselamatan dan kesehatan kerja dalam Undang – Undang Nomor 1 Tahun 1970. Dari fakta yang ada disarankan sebaiknya Pemerintah Provinsi Lampung memberi kebijakan untuk menambah jumlah pegawai pengawas ketenagakerjaan agar pengawasan keselamatan dan kesehatan kerja menjadi optimal, perlu ditinjau kembali Undang-Undang Nomor 1 Tahun 1970 Tentang Keselamatan Dan Kesehatan Kerja dimana sanksi atas pelanggaran keselamatan dan kesehatan kerja sudah tidak sesuai di masa kini, hendaknya Undang-Undang Nomor 1 Tahunn 1970 Tentang Keselamatan Dan Kesehatan Kerja direvisi lagi agar isi undang-undang tersebut lebih tegas dan sanksi hukum lebih disesuaikan dengan keadaan sekarang Abstract Caring for the safety and health, the government tried to create the great role that was given to the supervisory of employee cared for. Thelawin number 13, 2003, about the employee on Paragraphs86 ayat (1) and (2), there are: Ayat (1) the employee have the right to get the protection for the safety, health, morality, and decency and also treatment that appropriated with dignity as human being and religion aspects. Ayat (2) protecting the safety the employee to create the optimality works productivity was did effort the safety and health. The safety and health is important to get attention, so the government tried create the effective role of monitoring, implementation and taking action against either the private enterprise or state owned by government in monitoring the safety and health in Lampung. The problems of the research was how to the cumberer of roles and factors of supervisory of employee monitoring the workers safety and health in Lampung The close of the research was nearing in empiric normative aspect. The source of the data was primary and secondary data that was done with the studying of the book and practice. Based on the research, implementation the norm of safety and health, showing the problems, there were: the enterprises have not the committee of the workers safety and health (P2K3), implemented the safety and health in workers area, has the experts of the workers safety and health yet, there was no appropriate between the number of employees and the enterprise in Lampung, also infirming the punishment in law number 1, 1970. Based on this discussion, the researcher give the suggestion, there are : the local government should give the policy to add the fund that is allocated to The Employees Department of Bandar Lampung, especially to add the number of supervisory of employee in order to they works optimally, more investigating the law number 1, 1970 about the workers safety and health containing the punishment is not appropriate anymore. The law should be explicit and appropriate.
