ABSTRAK PERLINDUNGAN HUKUM KONSUMEN TERHADAP MAKANAN DAN MINUMAN YANG TIDAK BERSERTIFIKAT HALAL Oleh DEA ASRIKA Perlindungan hukum terhadap konsumen adalah upaya pemerintah menjamin adanya kepastian hukum untuk memberi perlindungan kepada masyarakat agar hak-haknya sebagai konsumen tidak dilanggar. Adapun permasalahan dalam penulisan tesis ini adalah bagaimana perlindungan hukum konsumen terhadap makanan dan minuman yang tidak halal/tidak bersertifikat halal dan bagaimana sistem ganti kerugian yang diperoleh konsumen terhadap makanan dan minuman yang tidak halal/tidak bersertifikat halal. Pendekatan masalah yang digunakan adalah pendekatan yuridis normatif dan pendekatan yuridis empiris sebagai penunjang. Narasumber penelitian adalah Kasi Kesmavet Dinas Ketahanan Pangan, Pertanian dan Peternakan Kota Metro. Pengumpulan data dilakukan dengan studi pustaka dan studi lapangan. Hasil penelitian dan pembahasan menunjukan bahwa (1) Upaya perlindungan hukum bagi konsumen terhadap makanan dan minuman yang tidak halal dan/atau tidak bersertifikat halal di Kota Metro cukup maksimal. Dalam hal kehalalan suatu produk dinas pertahanan pangan, pertanian dan perternakan mempunyai peran sebagai badan yang memeriksa kandungan yang terdapat pada makanan atau minuman di rumah makan yang ada di Kota Metro. Dinas Ketahanan Pangan, Pertanian dan Peternakan secara rutin setiap minggu melakukan surveillans pada pelaku usaha pangan dan hewan baik olahan daging susu telur dan produk olahan lainnya seperti bakso, mie ayam nugget dan sosis. Kegiatan ini telah dilakukan secara rutin disetiap minggunya oleh laboratorium kesmavet kota Metro. kemudian dicek di laboratoriun ternyata hasilnya ada yang positif mengandung babi langsung dari laboratorium kesmavet melaporkan hasilnya ke dinas ketahanan pangan, pertanian dan perternakan kota metro. Dari dinas akan ditindak lanjuti oleh pengawas kesmavetnya ibu drh. Ruri Astuti. Bentuk perlindungan hukum yang dilakukan pemerintah Kota Metro adalah dengan memeriksa dan mengawasi makanan olahan daging, susu, telur yang dan produk olahan lainnya yang beredar di Kota Metro. Bila pelaku usaha terbukti menggunakan bahan olahan daging babi di produknya maka pelaku usaha wajib memberi informasi bahwa produk olahannya menggunakan olahan daging babi di label/banner produk usahanya.(2) Upaya preventif yang dilakukan oleh Dinas Ketahanan Pangan, Pertanian dan Perternakan berkerjasama dengan LP POM MUI terkait dengan produk olahan pelaku usaha yang menjual produk tidak halal dan/atau tidak bersertifikat halal di Kota Metro yaitu dengan melaksanakan sosialisasi kepada para pelaku usaha di Kota Metro. Upaya represif yang dilakukan oleh Dinas Ketahanan Pangan, Pertanian dan Perternakan berkerjasama dengan LP POM MUI terkait dengan produk olahan pelaku usaha yang menjual produk tidak halal dan/atau tidak bersertifikat halal di Kota Metro yaitu dengan memberikan hukuman atau sanksi berupa sanksi administratif yang dapat diterapkan secara berjenjang mulai dari dengan diberikan teguran/peringatan, denda sampai pada pencabutan ijin usaha. Saran dalam penelitian ini adalah: Pemerintah dan lembaga terkait haruslah memberikan pembinaan sosialisasi secara maksimal untuk konsumen dan pelaku usaha mengenai pentingnya memberikan informasi yang jelas terkait produk yang dijual. Perlunya akses yang menunjang, aturan dan tatacara yang kuat bagi masyarakat untuk menyampaikan pendapat, usul dan keluhan terhadap ketidak jujuran informasi oleh pelaku usaha. Peran MUI sebagai pelaksana sertifikasi halal haruslah memaksimalkan pelaksanaannya agar tidak pasif. Bagi pelaku usaha janganlah menjadi pelaku usaha“nakal” dengan memasukan bahan olahan daging babi dan tidak mencantumkan informasi yang jelas terkait komposisi produk tersebut. Pemerintah harus lebih mempublikasikan bahwa produk olahan tersebut mengandung babi pada media. Jadilah konsumen yang cerdas dengan teliti atau bertanya sebelum membeli produk. ABSTRACT CUSTOMER'S CONSUMER PROTECTION OF FOOD AND BEVERIFICATION OF HALAL CERTIFICATE By DEA ASRIKA Legal protection of consumers is the government's effort to ensure legal certainty to give protection to the public so that their rights as consumers are not violated. The problem in writing this thesis is how the protection of consumer law against foods and beverages that are not kosher / not certified halal and how the system of compensation obtained by consumers to food and beverages that are not kosher / not certified halal. The problem approach used is the normative juridical approach and the empirical juridical approach as a supporter. The research sources are Kasi Kesmavet Food Security, Agriculture and Livestock Office of Metro City. Data collection was done by literature study and field study. The results of research and discussion show that (1) The legal protection efforts for consumers against food and beverages that are not kosher and / or not certified halal in Metro City is maximum. In the case of the halal of a product of the defense service of food, agriculture and animal husbandry has a role as a body that check the content contained in food or beverages in restaurants in Metro City. Food Security, Agriculture and Animal Husbandry Department regularly conducts surveillance on food and animal business perpetrators of processed egg milk meat and other processed products such as meatballs, chicken nugget noodles and sausages. This activity has been done routinely every week by Metro municipal laboratory.
