Abstrak

Putusan Mahkamah Konstitusi ini mempertegas dan memperkuat kedudukan Pasal 21 UUPA, bahwa hanya warga negara Indonesia yang dapat mempunyai hak milik atas tanah. Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 telah mengubah norma dan tatanan (pembuatan) perjanjian perkawinan yang diatur dalam Pasal 29 Undang-Undang Perkawinan. Penelitian ini mengkaji pemisahan harta perkawinan pasca Putusan MK No. 69/PUU-XIII/2015 pada pasangan perkawinan campuran serta faktor-faktor yang mempengaruhi pemisahan harta untuk menghindari kepemilikan tanah hak milik oleh orang asing. Metode penelitian ini menggunakan penelitian normatif dan empiris berdasarkan fakta-fakta hukum yang bersumber dari substansi peraturan perundang-undangan, serta penelitian hukum empiris dengan berdasarkan hasil riset pada Kantor Hukum Farida Law Office. Penelitian normatif mengkaji peraturan perundang-undangan, dan penelitian empiris mengkaji data lapangan yang diperoleh dari Kantor Hukum Farida Law Office di Jakarta. Hasil penelitian ini menunjukan bahwa, dengan terbitnya Putusan MK No. 69/PUU-XIII/2015 perjanjian perkawinan dapat dibuat sebelum, pada saat, setelah perkawinan dilangsungkan dengan dibuktikan akta notaris sesuai Pasal 3 Ayat (2) PP No. 103 Tahun 2015. Keputusan ini memberikan jaminan kesetaraan hak dalam hal ini hak untuk dapat memiliki tanah hak milik, dan kepastian hukum bagi WNI pelaku perkawinan campuran. Namun, masih banyak masyarakat yang belum mengetahui perjanjian perkawinan pasca Putusan MK No. 69/PUU-XIII/2015 karena belum tersosialisasikan secara optimal. Serta, tidak jarang notaris menolak membuat perjanjian perkawinan baik antara WNI-WNA maupun pasangan WNI-WNI, karena dapat diindikasikan sebagai perbuatan melawan hukum. Mengingat luasnya cakupan atau substansi perjanjian perkawinan yang belum ada batasan dengan tegas, disarankan agar pemisahan harta yang terdapat dalam Pasal 3 Ayat (2) PP No. 103 Tahun 2015 harus dijelaskan secara terperinci, serta Pemerintah dalam hal ini Kementrian Hukum dan HAM seharusnya dapat menindaklanjuti Putusan MK No. 69/PUU-XIII/2015 terkait pelaksanaan tugas notaris selaku pejabat umum yang membuat atau mengesahkan perjanjian perkawinan. Kata Kunci : Pemisahan Harta, Perkawinan Campuran, Tanah Hak Milik abstract This Constitutional Court ruling reinforces and reinforces the position of Article 21 of the UUPA, that only Indonesian citizens can own land rights. Decision of the Constitutional Court Number 69 / PUU-XIII / 2015 has changed the norm and arrangement (making) of marriage agreement set forth in Article 29 of the Marriage Law. This study examines the separation of marriage property after the Constitutional Court Decision No. 69 / PUU-XIII / 2015 on mixed marriage couples as well as factors affecting the separation of property to avoid foreign ownership of land rights. This research method uses normative and empirical research based on legal facts derived from the substance of legislation, as well as research empirical law with based on the results of research at the Law Office Farida Law Office. The normative study examines legislation, and empirical studies examine field data obtained from the Farida Law Office in Jakarta. The results of this study indicate that, with the issuance of Decision No. MK. 69 / PUU-XIII / 2015 the marriage agreement may be made before, at the time, after the marriage takes place with the proven notary deed pursuant to Article 3 Paragraph (2) of PP. 103 of 2015. This decree provides a guarantee of equality of rights in this case the right to own land of property rights, and legal certainty for Indonesian citizens mixed marriage. However, there are still many people who do not know the marriage agreement after the Constitutional Court Decision No. 69 / PUU-XIII / 2015 because it has not been optimally socialized. And, not infrequently the notary publicly refused to make a marriage agreement either between WNI-WNA and the couple citizen-WNI, because it can be indicated as an act against the law. In view of the extent of the coverage or substance of the marriage agreement that has not been strictly defined, it is recommended that the separation of the property contained in Article 3 Paragraph (2) of PP. 103 Year 2015 should be explained in detail, and the Government in this case the Ministry of Justice and Human Rights should be able to follow up the Constitutional Court Decision No. 69 / PUU-XIII / 2015 relating to the execution of a notary's duties as the general official making or ratifying the marriage agreement.
