Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Fitur Go-Food dalam aplikasi Go-Jek merupakan layanan jual beli antara konsumen (pemesan) dengan penjual melalui perantaraan pengemudi Go-Jek. Ketertarikan mengkaji layanan Go-Food adalah adanya perbedaan pandangan dalam perspektif hukum Islam mengenai halal atau haramnya menggunakan layanan tersebut. Rumusan masalah penelitian ini adalah: (1) Bagaimanakah syarat dan prosedur transaksi jual beli melalui jasa Go-Food? (2) Bagaimanakah perspektif hukum Islam terhadap transaksi jual beli melalui jasa Go-Food? Penelitian ini menggunakan jenis normatif, dengan pendekatan deskriptif dan pendekatan normatif terapan. Data dikumpulan dengan prosedur studi kepustakaan dan studi dokumen. Analisis data dilakukan secara yuridis kualitatif. Hasil penelitian ini menunjukkan: (1) Syarat transaksi jual beli melalui jasa Go-Food adalah menginstal aplikasi Go-Jek dan mematuhi syarat dan ketentuan yang telah ditentukan oleh pihak perusahaan, yaitu PT Aplikasi Karya Anak Bangsa. Prosedur transaksi jual beli melalui jasa Go-Food adalah konsumen memuka aplikasi Go-Jek pada smartphone, lalu memilih fitur Go-Food, memilih lokasi pembelian, memilih dan menentukan jumlah makanan atau minuman, meng-klik pesan, memilih metode pembayaran, menunggu sistem Go-Jek mencarikan pengemudi, pengemudi menelpon konsumen untuk mengonfirmasi pesanan dan konsumen menunggu pesanan yang diantarkan oleh pengemudi. (2) Perspektif hukum Islam yang menghalalkan transaksi jual beli melalui jasa Go-Food didasarkan adanya dasar hukum dalam Al Qur’an dan Al Hadits yang memperbolehkan mewakilkan pembelian (wakalah bil ujrah) dan memandang pemanfaatan jasa pengemudi Go-Jek sebagai ijarah yang dibayar atas dasar keikhlasan. Perspektif hukum Islam yang mengharamkan transaksi jual beli melalui jasa Go-Food didasarkan adanya dasar hukum dalam Al Qur’an dan Al Hadits yang mengharamkan riba dan memandang bahwa terjadi penggabungan akad (al ‘uquud al murakkabah) yang hukumnya adalah haram. Saran dalam penelitian ini adalah Majelis Ulama Indonesia dan Dewan Syariah Nasional disarankan untuk mengeluarkan fatwa mengenai transaksi jual beli dengan menggunakan jasa pengemudi ojek online, , sehingga menjadi acuan bagi konsumen yang beragama Islam dalam memanfaatkan layanan tersebut. Kata Kunci: Transaksi Jual Beli, Go-Food, Hukum Islam TRANSACTIONS SELL BUY THROUGH GO FOOD SERVICES IN THE PERSPECTIVE OF ISLAMIC LAW Go-Food feature in Go-Jekis application is a buying and selling service between customers (buyers) and sellers through Go-Jek drivers. An interest in assessing Go-Food services is that there are differences of views in the perspective of Islamic law on halal or haramnya using the service. The formulation of this research problem are: (1) What is the terms and procedures of sale and purchase transactions through Go-Food services? (2) What is the perspective of Islamic law on buying and selling transactions through Go-Food services? This research uses normative type, with descriptive approach and applied normative approach. Data were collected by literature study procedures and document studies. Data analysis is done by qualitative juridical. The results of this study indicate: (1) Terms of sale and purchase transactions through Go-Food services is to install Go-Jek applications and comply with the terms and conditions set by the company, namely PT Karya Karya Anak Bangsa. The procedure of buying and selling transactions through Go-Food services is the consumer's Go-Jek app opens on the smartphone, then chooses Go-Food features, selects the purchase location, selects and determines the amount of food or drink, clicks the message, chooses the payment method, -Jek finds the driver, the driver calls the customer to confirm the order and the consumer waits for the order delivered by the driver. (2) Islamic legal perspective which justifies buying and selling transaction through Go-Food services based on the existence of legal basis in Al Qur'an and Al-Hadith which allow to represent purchasing (wakalah bil ujrah) and to see the utilization of Go-Jek driver service as ijara paid on the basis of sincerity. Islamic legal perspective which forbids buying and selling transactions through Go-Food services based on the legal basis in Al Qur'an and Al Hadith which forbid usury and view that there is a merger akad (al 'uquud al murakkabah) whose law is haram. Suggestion in this research is Majelis Ulama Indonesia and National Sharia Council is suggested to issue fatwa on sale and purchase transaction by using ojek driver service online,, so become reference for Moslem consumer in utilizing the service.
