Abstrak

Pasal 6 Convention on Rights of the Child 1989 menyatakan bahwa negara harus menjamin semaksimal mungkin kelangsungan dan perkembangan anak. Selanjutnya pasal 38 menjelaskan bahwa negara harus mengambil langkah yang mungkin dilakukan untuk menjamin perlindungan dan pemeliharaan anak-anak yang terkena dampak suatu konflik bersenjata. Menurut laporan PBB yang tertuang dalam resolusi a/res/70/1, negara yang sedang berkonflik setidaknya memenuhi lima hak dasar anak yakni pendidikan, hidup sehat, larangan perekrutan dan penggunaan tentara anak, serta mengakhiri segala bentuk kekerasan terhadap anak. Hal ini searah dengan ketentuan SDGs, terutama goals 2; mengakhiri kelaparan anak, goals 3; hidup sehat dan kesejahteraan anak, goals 4; pendidikan anak yang berkualitas, goals 8; pelarangan kerja paksa dan perekrutan tentara anak, dan goals 16; institusi yang damai, adil dan baik bagi anak. SDGs (Sustainable Development Goals) adalah cetak biru yang diadopsi oleh semua negara anggota PBB untuk perdamaian dan kemakmuran bagi manusia dan bumi, sekarang dan di masa depan, dengan upaya saling bahu membahu sehingga saat negara tidak dapat sepenuhnya memenuhi hak pada anak, negara lain dapat membantu memenuhi hak minimum bagi anak-anak yang berada di wilayah konflik. Berdasarkan uraian tersebut, penelitian ini membahas relevansi antara instrumen hukum internasional dan kerangka SDGs sebagai upaya pencapaian tujuan SDG untuk memenuhi hak anak di wilayah konflik bersenjata internasional. Penelitian ini menggunakan metode yuridis normatif. Sumber data diambil dari data sekunder, bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, sedangkan pengumpulan data menggunakan metode studi pustaka yang dianalisis menggunakan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa SDGs mengakomodir ketentuan perlindungan hak-hak anak di wilayah konflik bersenjata berdasarkan peraturan�peraturan internasional dan upaya pemenuhan hak anak melalui SDGs dilakukan dibawah kerjasama organisasi internasional dan negara netral. Kata Kunci: Hak Anak, Konflik Bersenjata Internasional, Sustainable Development Goals (SDGs) Article 6 of the 1989 Convention on Rights of the Child states that the state must ensure the maximum possible survival and development of children, further article 38 states that the state must take all possible steps to ensure the protection and care of children affected by armed conflict. However, according to the UN report set out in a/res/70/1 resolution, the conflicting country fulfills at least five basic rights of children namely education, healthy living, prohibitions on recruiting and using child soldiers and ending all forms of violence against children. This is in line with the provisions of the SDGs (Sustainable Development Goals), especially goals 2; ending child hunger, goals 3; healthy life and child welfare, goals 4; quality children's education, goals 8; prohibition of forced labor and recruitment of child soldiers, and goals 16; institutions that are peaceful, fair and good for children. The SDGs are the blueprint adopted by all UN member states for peace and prosperity for people and the earth, now and in the future, by working hand in hand so when the state cannot fully fulfill the rights of children, other countries can help fulfill the minimum rights for children in conflict areas. Based on this description, this study discusses the relevance between international law instruments with SDGs framework through achieving SDGs goals fulfilling children's rights in international armed conflict areas. This research uses the normative juridical method based on secondary data, primary legal materials, secondary legal materials, and tertiary legal materials. Data were collected via literature study then analyzed using qualitative analysis methods. The results of the study indicate that the SDG has accommodated the provisions that protect children's rights in areas of armed conflict in accordance with international law instruments and efforts on it were executed under the partnership of international organizations and neutral states.
