Abstract
Abstrak Bahasa Indonesia Keberadaan rekam medis sangat diperlukan dalam setiap sarana pelayanan kesehatan, baik ditinjau dari segi pelaksanaan praktik pelayanan kesehatan maupun dari aspek hukum. Peraturan hukum berhubungan dengan pelaksanaan pelayanan kesehatan mencakup aspek hukum pidana, hukum perdata, dan hukum administrasi. Dari aspek hukum, rekam medis dapat dipergunakan sebagai alat bukti dalam perkara medi s, sesuai dengan Pasal 184 ayat (1) KUHAP . Permasalahan dalam penelitian ini adalah bagaimanakah kekuatan pembuktian alat bukti rekam medis dalam penegakan huku m pidana malpraktek kedokteran. Pendekatan yang digunakan dalam pembahasan penulisan penelitia n ini adalah pendekatan secara yuridis normatif dan yuridis empiris . Metode pengumpulan data diperoleh melalui studi kepustakaan dan wawancara . Metode penyajian data dilakukan melalui proses editing, sistematis, dan klasifikasi. Metode analisis data yang d ipergunakan adalah metode analisi s kualitatif dan menarik ke s impulan secara deduktif. K ekuatan pembuktian alat bukti rekam medis merupakan alat bukti yang kuat berbentuk surat, alat bukti rekam medis merupakan petunjuk bagi hakim di dalam tindak pidana ma lpraktek kedokteran untuk menjadi dasar memperberat atau memperingan dalam pertimbangan hukum hakim pada saat memutuskan perkara di persidangan. Adapun saran yang diberikan terkait dugaan malpraktek medis, Pengaturan Undang - Undang Nomor 29 Tahun 2004 tentang Praktek Kedokteran, diperlukan adanya revisi ulang tentang ketentuan pidana untuk menjamin kepastian dan perlindungan hukum pasien sebagai korban malpraktek kedokteran. Kata kunci: Rekam Medis , Alat Bukti , Malpraktek Kedokteran Abstrak Bahasa Ingris The axistence of medical record is needed in every healty facility sevice, both observe from operation aspect of practice service and law aspect. The rule of justice is relation with impementation of healt service, such as criminal of justice aspect, court of justice and administr ation justice. From the justice aspect, medical record can be used as the proof in medical case, that consistance with passage 184 verse (1) KUHAP. The problem in this research is how the strength of proof instrument authentication in malpractice madicine criminal law enforcement. The approach the be used in this reasearch is the approach normatif yuridis and empiris yuridis. The strength of proof instrument authentication medical record is the clue for adjudicator in the act of medicine malpractice crimina l to be basic to make the punishment heavier or lighten consideration from adjudicator justice at the moment to adjudicate the case in the cort session.
