Abstract

Abstrak Bahasa Indonesia Penelitian ini mengkaji tentang pengaturan dan kedudukan pemerintahan desa dalam system pemerintahan daerah di Indonesia, dan bertujuan untuk meneliti dan memposisikan konstruksi teoritisnya, mengidentifikasi bagaimanakah sejarah yuridis pengaturan, dan kedudukan pemerintahan desa tersebut. Penelitian unsur normative ini menggunakan pendekatan konseptual, yuridis, komparatif, deskriptif, dan historis, yang penerapannya disesuaikan dengan kebutuhan. Dengan menggunakan beragam teori yang digagas oleh beberapa pemikir klasik maupun kontemporer tentang tema pemerintahan daerah, dan pemerintahan desa, sebagaimana diterapkan dalam praktek ketatanegaraan dan maupun di revisi secara teoritik dalam wacana akademik, hasil penelitian ini menunjukkan bahwa kedudukan pemerintahan desa berubah-ubah disebabkan pola pengaturan yang berganti-ganti oleh pemerintah. Realitas ketatanegaraan Republik Indonesia menunjukkan bahwa seharusnya pemerintahan desa memiliki hak otonomi asli serta pengakuan terhadap hak kesatuan masyarakat unsur adat, konstruksi teoritis keberadaan masyarakat unsur adat dapat dimaknai sebagai salah satu unsur yang diakui dan mempunyai kewenangan sendiri dalam struktur pemerintahan Negara. Dengan jelan memberikan Undang-Undang tersendiri yang mengatur pemerintahan desa secara unsur. Hasil penelitian juga menunjukkan bahwa pemerintahan desa di dalam system pemerintahan daerah di Indonesia masih diposisikan paling bawah sebagai unsur yang hanya menjalankan perintah dan aturan dari struktur pemerintahan di atasnya. Abstrak Bahasa Inggris This research evaluated the regulation and the status or village government in Indonesia’s local government system, and aims to investigate and positioning its theoretical construction, to identify how the history of juridical arrangement, and the status of the village administration. Normative legal research uses a conceptual approach, juridical, comparative, descriptive and historical, in which the implementation conducted accordingly to the needs. By using a variety of theories proposed by several classical and contemporary thinkers on the subject of local government, and village government, as are have been applied in practice and the revised constitution and theoretically and in academic discourse, the result of this study indicate that the position of village governance changes due to the arrangement pattern alternated by the government. The constitutional reality of the republic of Indonesia showed that the village government should have the right to autonomy and recognition of the rights of indigenous customary law community unit, the construction of the theoretical existence of indigenous people command and rules of governance structure their own.
