Abstract
ABSTRAK Pelaksanaan demokrasi desa di Indonesia didukung oleh Undang-Undang Nomor 32 tahun 2014 tentang Pemerintahan Desa. Pemerintah Desa sebagai lembaga eksekutif dan BPD sebagai lembaga legislatif. Sesuai dengan fungsinya, BPD sebagai lembaga yang menjalankan fungsi legislasi yaitu menetapkan peraturan desa bersama kepala desa, menampung dan menyalurkan aspirasi masyarakat. Pembuatan peraturan desa merupakan salah satu kegiatan pemerintahan yang didasarkan persetujuan Kepala Desa, BPD dan masyarakat desa. Untuk itu diharapkan efektifitas penerapan fungsi tersebut dapat mewujudkan keseimbangan kekuatan antara masyarakat yang diwakili oleh BPD dengan Pemerintah Desa.Tujuan penelitian ini adalah untuk mengetahui penerapan fungsi legislasi Badan Permusyawaratan Desa dalam pembuatan peraturan desa di Desa Banyumas. Tipe penelitian yang digunakan adalah deskriptif dengan pendekatan kualitatif. Teknik pengumpulan data yang digunakan melalui wawancara mendalam, observasi dan dokumentasi, sedangkan teknik pengolahan data yang digunakan adalah tahap editing, kategorisasi dan interpretasi.Hasil penelitian ini menunjukkan bahwa penerapan fungsi legislasi Badan Permusyawaratan Desa dalam pembuatan peraturan desa belum berjalan dengan baik. Indikator penerapan fungsi legislasi dalam pembuatan peraturan desa dilihat dari dua tahap yaitu proses menyerap dan menyalurkan aspirasi masyarakat. Proses penyerapan aspirasi dan penyaluran aspirasi dapat dilihat dalam proses pembuatan peraturan desa yaitu pada tahap perancangan, pembahasan dan penetapan peraturan desa.Kata kunci : Fungsi Legislasi, Peraturan Desa. ABSTRACT The implementation of the village democracy in Indonesia is supported by law No. 32 of 2014 on Village Government. The Village Government as the executive agency and BPD as legislative body. Compatible with that, BPD as an institution which carries on the function of legislation that determination the village regulation with the Village Chief, accommodate and distribute public aspirations. The manufacture of village regulation is one of Government activity which is based on the approval of the Village Chief, BPD and villagers. It is expected the effectiveness of these function can realize a power balance of villagers who represented by BPD and the Village Government. The purpose of this study was to determine the implementation of legislation function Village Consultative Body (BPD) in the manufacture of village regulation at Banyumas Village. Type of research used is descriptive qualitative approach. Data collection techniques used through in-depth interviews, observation and documentation, while data processing technique used is the editing stage, categorization and interpretation. The results of this study indicate that the implementation of legislation function Village Consultative Body (BPD) in the manufacture of village regulation has not run well . The indicator of the implementation of legislation function in the manufacture of village regulation can be seen from two steps: accommodate and distribute public aspirations. The process of accommodate and distribute of public aspirations can be seen in the manufacture of village regulation is on stage design, discussion and determination of village regulation.
