Jual beli online adalah kegiatan yang menyangkut kegiatan berbisnis (jual beli) dengan media internet. Jual beli online dapat dilakukan dengan memanfaatkan platform yang ada seperti Bukalapak, Tokopedia, Shopee, Lazada, dan lain-lain. Berbagai macam barang dapat dijual melalui platform tersebut, seperti emas dan yang lainnya. Dalam hal ini aplikasi Bukalapak meluncurkan fitur BukaEmas untuk mempermudah masyarakat dalam melakukan jual beli emas. Berdasarkan hal tersebut, penulis ingin melakukan penelitian agar dapat mengetahui dengan jelas prosedur dan proses pelaksanaan jual beli. Permasalahan dalam penelitian ini mengenai syarat dan prosedur dalam pelaksanaan jual beli emas secara online melalui fitur marketplace BukaEmas, serta hambatan yang mungkin terjadi dalam pelaksanaan jual beli emas secara online melalui fitur marketplace BukaEmas. Jenis penelitian menggunakan penelitian normatif dengan tipe penelitian deskriptif. Pendekatan masalah menggunakan tipe pendekatan perundangundangan dan pendekatan konseptual. Pengumpulan data menggunakan data primer, data sekunder, dan data tersier. Analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Hasil penelitian dan pembahasan dari tulisan ini disimpulkan bahwa fitur marketplace BukaEmas memiliki beberapa syarat dan prosedur yang ditujukan kepada para penggunanya dimana mereka sebagai calon pengguna harus memenuhi semua persyaratan yang ada seperti mengunggah Kartu Tanda Penduduk (KTP), Nomor Pokok Wajib Pajak (NPWP), dan beberapa dokumen penting lainnya. Hambatan yang terjadi selama pelaksanaan jual beli emas secara online ini berlangsung yaitu; ketidakjelasan persetujuan para pihak; batalnya perjanjian karena tidak cakap; dan kesalahan dalam pengiriman emas fisik. Kata Kunci: Jual Beli Emas Online, Marketplace, Jual Beli. Online buying and selling is an activity that involves doing business activities (buying and selling) with internet media. Online buying and selling can be done by utilizing existing platforms such as Bukalapak, Tokopedia, Shopee, Lazada, and others. A wide variety of goods can be sold through the platform, such as gold and others. In this case, the Bukalapak application launched the BukaEmas feature to make it easier for people to buy and sell gold. Based on this, the author wants to conduct research in order to clearly know the procedures and processes of buying and selling. The problems in this study are regarding the terms and procedures for the implementation of buying and selling gold online through the BukaEmas marketplace feature, as well as obstacles that may occur in the implementation of buying and selling gold online through the BukaEmas marketplace feature This type of research uses normative research with descriptive research type. The problem approach uses a statutory approach and a conceptual approach. Data collection uses primary data, secondary data, and tertiary data. The data analysis used in this study is qualitative analysis. The results of research and discussion from this paper concluded that the BukaEmas marketplace feature has several terms and procedures addressed to its users where they as prospective users must meet all existing requirements such as uploading Identity Cards (KTP), Taxpayer Identification Numbers (NPWP), and several other important documents. The obstacles that occur during the implementation of buying and selling gold online are taking place, namely; vagueness of the parties’ agreement; nullity of the agreement due to incompetence; and errors in physical gold delivery.
