Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Saat ini perkembangan teknologi informasi menjadi sarana untuk melakukan perbuatan tindak pidana yang sering kali melanggar norma-norma, salah satu contoh yaitu banyaknya kasus penyebaran konten asusila berupa gambar maupun video. Pada saat sekarang ini banyak sekali konten bermuatan pornografi yang beredar di internet, salah satunya onlyfans. Salah satu konten kreator onlyfans asal Indonesia adalah mahasiswi bernama Dea Ayu Dewanti alias “Dea Onlyfans”. Dea sendiri saat ini sudah ditangkap oleh polisi dan ditetapkan sebagai tersangka atas penyebaran konten pornografi. Dea pun bersedia mengajukan diri sebagai justice collaborator untuk membantu pihak kepolisian memberantas kasus-kasus serupa. Berdasarkan latar belakang tersebut, timbul persoalan mengenai bagaimanakah tindak lanjut permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada pihak kepolisian serta apakah yang menjadi faktor penghambat dalam permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada pihak kepolisian. Penulisan skripsi ini penulis akan menggunakan metode penelitian hukum normatifempiris dengan cara menganalisis peraturan perundang-undangan serta bahan bukum sekunder dengan pendekatan kualitatif yang akan menghasilkan data desktriptif dengan cara mengumpulkan data di lapangan dan mengkajinya dengan asas-asas dan norma hukum yang berkaitan dengan permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada pihak kepolisian. Para pihak yang terlibat sebagai narasumber di dalam penelitian ini terdiri dari Penyidik pada Ditreskrimsus Polda Metro Jaya DKI Jakarta dan Dosen Bagian Hukum Pidana Fakultas Hukum Universitas Lampung. Hasil penelitian menjelaskan bahwa permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada pihak kepolisian belum berhasil dikarenakan terjadinya miskomunikasi antara kuasa hukum Dea yang menekan kepolisian untuk Daffa Yudhistira memberikan status justice collaborator kepada kliennya, padahal penerapan peran justice collaborator hanya dapat diberikan oleh Lembaga Perlindungan Saksi dan Korban (LPSK) bukan oleh kepolisian. Sehingga permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada pihak kepolisian tidak dapat terlaksana karena belum sesuai dengan peraturan perundang-undangan yang berlaku. Sedangkan peran normatif dan peran ideal belum berperan secara keseluruhan karena kewajiban penegakan hukum dalam menjalankan tugasnya belum berjalan secara total enforcement. Kemudian penerapan pada peran faktual belum dapat dicapai karena fakta yang terjadi di lapangan belum melibatkan peran justice collaborator dalam mengungkap tindak pidana pornografi. Selanjutnya faktor penghambat dalam permohonan peran justice collaborator oleh pelaku tindak pidana pornografi kepada kepolisian yang paling dominan ialah terletak pada faktor hukumnya yaitu belum ada peraturan perundang-undangan yang tegas untuk dapat mempersingkat pemberian status justice collaborator. Mengingat eksistensi justice collaborator dalam membantu penanganan perkara suatu tindak pidana dibutuhkan model persuasif yang bersifat menyeluruh atas perlindungan kepada justice collaborator. Oleh karena itu, pada perlindungannya melibatkan semua komponen sistem peradilan pidana yang terdiri dari Kepolisian, Kejaksaan, Pengadilan, dan LPSK. Adapun saran yang diberikan penulis adalah perlunya aturan yang mengatur lebih lanjut mengenai justice collaborator guna memberikan pedoman untuk seluruh aparat penegak hukum dan perlindungan hukum kepada saksi pelaku yang bekerja sama. Serta diperlukan sumber daya manusia yang lebih terampil dalam memahami mengenai hukum pidana agar dapat menangani suatu perkara pidana dengan lebih efektif dan efesien. Kata Kunci: Justice Collaborator, Pembuktian, Pornografi Currently, the development of information technology is a means to commit criminal acts that often violate norms, one example is the many cases of spreading immoral content in the form of images or videos. At the present time there is a lot of pornographic content circulating on the internet, one of which is onlyfans. One of the onlyfans creator content from Indonesia is a student named Dea Ayu Dewanti alias “Dea Onlyfans”. Dea himself has now been arrested by the police and named as a suspect for spreading pornographic content. Dea was also willing to volunteer as a justice collaborator to help the police eradicate similar cases. Based on this background, the issue arises regarding how to follow up on the application for the role of justice collaborator by the perpetrator of the criminal act of pornography to the police and what are the inhibiting factors in the application for the role of justice collaborator by the perpetrator of the criminal act of pornography to the police. In writing this thesis, the writer will use the normative-empirical legal research method by analyzing laws and regulations as well as secondary book materials with a qualitative approach which will produce descriptive data by collecting data in the field and studying it based on legal principles and norms related to the application. the role of justice collaborators by perpetrators of pornographic crimes against the police. The parties involved as resource persons in this study consisted of investigators at the Jakarta Metro Jaya Regional Police Criminal Investigation Directorate and Lecturers of the Criminal Law Department at the Faculty of Law, University of Lampung. The results of the study explain that the application for the role of justice collaborator by the perpetrators of pornographic crimes to the police has not been successful due to a miscommunication between Dea's attorneys who pressured the police to grant justice collaborator status to their clients, even though the \ Daffa Yudhistira implementation of the role of justice collaborator can only be granted by the Witness and Victim Protection Agency. (LPSK) not by the police. So that the application for the role of justice collaborator by the perpetrators of pornographic crimes to the police cannot be carried out because it is not in accordance with the applicable laws and regulations. Meanwhile, the normative role and the ideal role have not played a full role because the obligation of law enforcement in carrying out their duties has not been carried out in total enforcement. Then the application of factual roles cannot be achieved because the facts that occur in the field do not involve the role of justice collaborators in uncovering pornographic crimes. Furthermore, the inhibiting factor in applying for the role of justice collaborator by perpetrators of pornographic crimes to the police is that the most dominant lies in the legal factor, namely that there are no strict laws and regulations to be able to shorten the granting of justice collaborator status. Given the existence of justice collaborators in assisting the handling of cases of a crime, a comprehensive persuasive model is needed for the protection of justice collaborators. Therefore, protection involves all components of the criminal justice system consisting of the police, prosecutors, courts and LPSK. The advice given by the author is the need for further regulations regarding justice collaborators in order to provide guidelines for all law enforcement officials and legal protection for witness witnesses who work together. It also requires human resources who are more skilled in understanding criminal law in order to be able to handle a criminal case more effectively and efficiently.
