Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

PET masuk kedalam jenis plastik dengan kode 1 yaitu dikenal dengan sebutan Polyethyelene Terephthalate(PETE). Tidak untuk air hangat apalagi panas, untuk jenis ini, disarankan hanya untuk satu kali penggunaan dan tidak untuk mewadahi pangan dengan suhu > 60°C. Penelitian ini mengkaji mengenai perlindungan hukum bagi konsumen produk makanan yang menggunakan kemasan berbahan dasar plastik Polyethyelene Terephthalate (PET) serta peran Pemerintah dalam penanggulangan penggunaan kemasan berbahan dasar plastik yang mengandung Polyethyelene Terephthalate (PET) sebagai wadah makanan. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan tipe penelitian deskriptif. Pendekatan masalah yang dilakukan dengan pendekatan normatif empiris, data yang digunakan adalah data primer yang diperoleh langsung dari lapangan dan data sekunder, yang terdiri dari bahan hukum primer, sekunder dan tersier. Metode pengumpulan data dengan studi kepustakaan, studi dokumen dan wawancara. Metode pengolahan data melalui pemeriksaan data, rekonstruksi data, dan sistematisasi data. Analisis data menggunakan analisis kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa perlindungan hukum bagi konsumen produk bahan makanan yang menggunakan kemasan berbahan dasar plastik Polyethyelene Terephthalate (PET) adalah berdasarkan Undang-Undang No. 8 Tahun 1999 Tentang Perlindungan Konsumen yang meliputi perlindungan terhadap barang dan/atau jasa. Adanya jaminan perangkat hukum negara yang dapat melndungi hak serta kewajiban masyarakat, serta adanya hukuman bagi orang yang tidak mengikuti peraturan yang ada. Peran Pemerintah dalam penanggulangan penggunaan kemasan berbahan dasar plastik yang mengandung Polyethyelene Terephthalate (PET) adalah dengan dilakukannya pengawasan secara berkala dalam bentuk razia. Tindak lanjut yang diambil dapat berupa teguran, penyitaan hingga pemusnahan bahkan sampai pencabutan izin usaha. Kata Kunci: Perlindungan Hukum, Konsumen, Plastik Polyethyelene Terephthalate (PET). PET is a type of plastic with code 1 which is known as Polyethylene Terephthalate (PET). PET is not for warm water or hot water, it is recommended for one-time use only and not for storing food with temperatures > 60°C. This research aims to examine legal protection for consumers of food products that use packaging made from Polyethylene Terephthalate (PET) plastic as well as the role of the Government in tackling the use of packaging made from plastic containing Polyethylene Terephthalate (PET) as food containers. The method used in this research is empirical juridical with a descriptive research design. The problem approach taken is an empirical normative approach, the data used is primary data obtained directly from the field and secondary data consisting of primary, secondary and tertiary legal materials. The data were taken from a literature study, document study and interviews. The data processing method used in this research is through data examination, data reconstruction, and data systematization using qualitative data analysis. The research and discussion showed that legal protection for consumers of food products that use packaging made from Polyethylene Terephthalate (PET) plastic is based on Law No. 8 of 1999 on Consumer Protection which includes protection of goods and/or services. There is a guarantee of state legal instruments that can protect the rights and obligations of the community, as well as penalties for people who do not follow existing regulations. The Government's role in tackling the use of plastic-based packaging containing Polyethylene Terephthalate (PET) is to carry out regular supervision in the form of raids. Besides, the follow-up action taken can be in the form of a warning, confiscation to destruction and even revocation of the business license.
