Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Tindak pidana korupsi merupakan kejahatan luar biasa (extraordinary crime) yang menghambat pembangunan bangsa dan merusak kepercayaan publik terhadap aparat penegak hukum. Salah satu bentuknya adalah pemotongan dana Bantuan Operasional Keluarga Berencana (BOKB) di Kabupaten Tanggamus yang melibatkan pejabat daerah. Penelitian ini bertujuan untuk menganalisis peran penyidik Kejaksaan dalam penanganan tindak pidana korupsi pemotongan dana BOKB serta mengidentifikasi faktor-faktor yang menghambat efektivitas penyidikan. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan yuridis empiris dengan sumber data primer melalui wawancara serta data sekunder berupa peraturan perundang-undangan dan literatur terkait. Data dianalisis secara kualitatif dengan menekankan pada aspek normatif dan implementasi di lapangan. Hasil penelitian menunjukkan bahwa Kejaksaan Negeri Tanggamus berperan penting dalam upaya represif pemberantasan tindak pidana korupsi, meliputi penyelidikan, penyidikan, hingga penuntutan terhadap pelaku. Dalam perkara Nomor: PDS/02/TGMS/07/2022, penyidik kejaksaan berhasil mengungkap modus pemotongan anggaran BOKB sebesar 17,5% dari setiap pencairan dana yang mengakibatkan kerugian negara sekitar Rp1,55 miliar. Namun, proses penegakan hukum menghadapi sejumlah hambatan, antara lain kesulitan menghadirkan saksi yang konsisten, keterbatasan sarana dan prasarana, serta lambatnya proses audit investigasi untuk menghitung kerugian negara. Berdasarkan temuan tersebut, penelitian ini menyarankan agar penyidik meningkatkan koordinasi dengan lembaga legislatif dan instansi terkait guna memperkuat legitimasi dan efektivitas penegakan hukum. Selain itu, pemerintah perlu menyediakan sarana dan prasarana khusus yang memadai untuk mendukung kinerja kejaksaan dalam menangani perkara korupsi, sehingga pemberantasan tindak pidana korupsi dapat dilakukan secara lebih cepat, adil, dan tuntas. One of its manifestations is the embezzlement of Family Planning Operational Assistance (BOKB) funds in Tanggamus Regency involving local officials. This study aims to analyze the role of prosecutors as investigators in handling corruption related to the embezzlement of BOKB funds and to identify factors that hinder the effectiveness of the investigation process. The research employs a normative and empirical juridical approach, using primary data obtained through interviews and secondary data from relevant laws, regulations, and literature. The data were analyzed qualitatively, focusing on normative aspects and their implementation in practice. The findings reveal that the Tanggamus District Prosecutor’s Office plays a crucial role in the repressive efforts to eradicate corruption, which includes investigation, prosecution, and trial proceedings. In case Number: PDS/02/TGMS/07/2022, the prosecutors succeeded in uncovering a scheme involving a 17.5% cut from each BOKB fund disbursement, causing state losses of approximately IDR 1.55 billion. Nevertheless, law enforcement encountered several obstacles, such as difficulties in securing consistent witness testimonies, limited facilities and infrastructure, and delays in audit investigations to calculate state financial losses. Based on these findings, the study suggests that prosecutors enhance coordination with legislative bodies and related institutions to strengthen legitimacy and effectiveness in law enforcement. Furthermore, the government should provide adequate facilities and infrastructure to support the work of prosecutorsin handling corruption cases, thereby ensuring a faster, fairer, and more comprehensive eradication of corruption.
