Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Salah satu permasalahan yang muncul karena kelemahan rumah sakit dalam menjaga kerahasiaan data rekam medis pasien adalah kebocoran data rekam medis. Pasien sebagai subjek data pribadi merasa adanya potensi kebocoran data di luar dari pihak yang berwenang. Diduga terdapat pengungkapan kondisi medis pasien oleh pihak tenaga kesehatan tanpa adanya izin dari pihak pasien maupun keluarga, sehingga dapat memunculkan banyak kerugian kepada pasien. Untuk itu perlu analisis lebih lanjut mengenai, bagaimana bentuk perlindungan hukum data kesehatan pasien menurut Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi dan bagaimana upaya hukum yang dapat ditempuh jika terjadi kebocoran data. Jenis penelitian ini adalah penelitian normatif dengan tipe penelitian deskriptif. Pendekatan masalah yang digunakan adalah pendekatan perundang-undangan. Data yang digunakan adalah data sekunder. Metode pengumpulan data melalui studi kepustakaan dan tambahan data melalui wawancara oleh Kepala Divisi Advokasi LBH Bandar Lampung. Metode pengolahan data melalui seleksi data, klasifikasi data, penyusunan data, serta dianalisis secara kualitatif. Hasil penelitian dan pembahasan penelitian yaitu bentuk perlindungan hukum yang ada di UU Pelindungan Data Pribadi bagi subjek data pribadi dan data rekam medis brerupa perlindungan preventif maupun represif. Perlindungan preventif melalui hak dan kewajiban yang harus dipenuhi baik data yang melalui sistem elektronik atau nonelektronik. Upaya hukum yang dapat ditempuh jika terjadi kebocoran data oleh pasien dapat berupa pengaduan kepada pihak rumah sakit, hingga pemberian sanksi administratif kepada pihak yang melanggar larangan yang telah ditetapkan oleh UU Pelindungan Data Pribadi. Patients as subjects of personal data feel that there is a potential for data leakage outside of the authorities. It is suspected that there is a disclosure of the patient's medical condition by health workers which can cause a lot of losses to patients. Therefore, further analysis is needed regarding what the legal form of protection of patient health data is according to Law Number 27 of 2022 concerning Personal Data Protection and what legal remedies can be taken in the event of a data leak This type of research is normative research with a descriptive research type. The problem approach used is the legislative approach. The data used is secondary data. The method of data collection is through literature study and additional data through interviews by the Head of the Advocacy Division of LBH Bandar Lampung. Data processing methods through data selection, data classification, data preparation, and qualitative analysis. The results of the research and discussion of the research are the forms of legal protection in the Personal Data Protection law for the subject of personal data and medical record data. In the form of preventive and repressive protection. Preventive protection through rights and obligations that must be fulfilled, both data through electronic and non-electronic systems. Legal remedies that can be taken in the event of a data leak by the patient can be tn the form of complaints to the hospital, to the provision of administrative sanctions to parties who violate the probihitions set by the Personal Data Protection Law.
