Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Eksistensi gugatan warga negara telah diakui secara yuridis dalam sistem hukum Indonesia melalui Perma Nomor 1 Tahun 2023, dimana mekanisme ini secara konseptual memberi akses bagi warga negara untuk menggugat pemerintah atas pelanggaran hak-hak mereka yang bersifat multisektoral. Namun, saat ini Perma tersebut masih berfokus pada permasalahan lingkungan hidup, meski dalam prakteknya sudah meluas ke sektor lain, artinya implementasi mekanisme ini masih menghadapi berbagai tantangan khususnya terkait ruang lingkup keberlakuan, ketidakjelasan norma dan prosedur. Di sisi lain, Teori keadilan bermartabat menekankan pentingnya nilai kemanusiaan dan moralitas dalam hukum, sehingga dapat memperkuat efektivitas gugatan warga negara. Permasalahan yang dibahas dalam penelitian ini adalah mengenai, bagaimana regulasi dan karakteristik gugatan warga negara di Indonesia ?, apa saja tantangan dalam penerapan gugatan warga negara di Indonesia ? dan bagaimana rekonstruksi gugatan warga negara untuk mewujudkan keadilan bermartabat?. Pembahasan disertasi ini akan menggunakan penelitian hukum normatif empiris dengan pendekatan Undang-Undang, pendekatan kasus serta perbandingan hukum. Hasil dari penelitian ini memaparkan jika regulasi terkait gugatan warga negara saat ini masih belum komperhensif dalam mengakomodir karakteristik khusus gugatan warga negara sehingga diperlukan melakukan rekonstruksi terhadap desain norma maupun desain prosedur menggunakan pendekatan konsep keadilan bermartabat untuk menemukan bentuk ideal dari mekanisme gugatan warga negara dengan tujuan mengoptimalkan peran gugatan warga negara dalam sistem hukum di Indonesia. Kata Kunci: Gugatan Warga Negara, Keadilan Bermartabat, Rekonstruksi.The existence of citizen lawsuits has been recognized in the Indonesian legal system through Perma 1/2023, whereby this mechanism conceptually provides citizens with access to sue the government for violations of their multisectoral rights. However, currently, this Perma still focuses on environmental issues, even though in practice it has expanded to other sectors, meaning that the implementation of this mechanism still faces various challenges, particularly related to its scope of application and the ambiguity of norms and procedures. On the other hand, the theory of dignified justice emphasizes the importance of humanity and morality in law, thereby strengthening the effectiveness of citizen lawsuits The issues discussed in this study are: how are citizen lawsuits regulated and characterized in Indonesia? What are the challenges in implementing citizen lawsuits in Indonesia? And how can citizen lawsuits be reconstructed to achieve dignified justice? This dissertation discussion will use empirical normative legal research with a statutory approach and a case approach, as well as legal comparison. The results of this study show that current regulations related to citizen lawsuits are still not comprehensive in accommodating the specific characteristics of citizen lawsuits. Therefore, it is necessary to reconstruct the design of norms and procedures using a dignified justice concept approach to find the ideal form of citizen lawsuit mechanisms with the aim of optimizing the role of citizen lawsuits in the Indonesian legal system.
