Jaksa Penuntut Umum dalam Penerapan Keadilan Restoratif para Penyelesaian Tindak Pidana Penganiayaan. Keadilan Restoratif muncul sebagai paradigma baru dalam hukum pidana yang menekankan pemulihan kembali (Restoratif) dibandingkan dengan pembalasan (Retributif), sebagaimana diatur dalam Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Penelitian ini bertujuan untuk mengetahui bagaimana peran Jaksa Penuntut Umum dalam penerapan keadilan restoratif, faktor-faktor yang mempengaruhi keberhasilan dalam penerapannya, serta hambatan yang dihadapi oleh Jaksa Penuntut Umum dalam penerapan keadilan restoratif pada penyelesaian tindak pidana penganiayaan. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dan yuridis empiris, dengan menekankan pada kajian kaidah hukumnya, dan data yang digunakan adalah data sekunder dan data primer. Pengumpulan data dilakukan dengan studi kepustakaan dan studi lapangan. Narasumber dalam penelitian ini yaitu Jaksa di Kejaksaan Negeri Bandar lampung dan Dosen Bagian Pidana Fakultas Hukum Universitas Lampung Hasil penelitian dan pembahasan menunjukan bahwa Jaksa Penuntut Umum berperan sebagai fasilitator perdamaian antara pelaku dan korban, pengawas terhadap proses kesepakatan, sekaligus sebagai pihak yang menentukan kelayakan penghentian penuntutan dengan memperhatikan syarat-syarat formil maupun materil sesuai dengan Peraturan Kejaksaan Nomor 15 Tahun 2020. Faktor-faktor yang mempengaruhi keberhasilan penerapan keadilan restoratif meliputi substansi hukum yang jelas, integrasi aparat penegak hukum, dukungan sarana dan fasilitas, keterlibatan masyarakat, serta penerimaan budaya hukum oleh masyarakat. Hambatan yang masih ditemui antara lain, kurangnya pemahaman masyarakat tentang pendekatan keadilan restoratif dalam sistem peradilan hukum pidana di indonesia, serta potensi penyalahgunaan wewenang oleh aparat penegak hukum. Saran dari penelitian ini adalah Kejaksaan harus lebih gencar dalam mensosialisasikan keadilan restoratif kepada masyarakat, meningkatkan kapasitas Jaksa Penuntut Umum sebagai fasilitator perdamaian, memperkuat dan menambah keberadaan Rumah Keadilan Restoratif dan sarana digital yang ada. Selain itu, peraturan mengenai penghentian penuntutan berdasarkan keadilan restoratif perlu dicantumkan dalam ketentuan hukum pidana formil atau dapat dimasukan didalam peraturan perundang-undangan yang berlaku. Public Prosecutors in the Implementation of Restorative Justice in the Settlement of Criminal Acts of Abuse. Restorative Justice has emerged as a new paradigm in criminal law that emphasizes restoration (Restorative) compared to revenge (Retributive), as regulated in Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. This study aims to determine the role of Public Prosecutors in the implementation of restorative justice, the factors that influence the success of its implementation, and the obstacles faced by Public Prosecutors in the implementation of restorative justice in the settlement of criminal acts of abuse. The research method used is a normative and empirical juridical approach, emphasizing the study of legal principles. The data used are secondary and primary data. Data collection was conducted through literature review and fieldwork. The sources in this study were prosecutors at the Bandar Lampung District Attorney's Office and lecturers at the Criminal Division of the Faculty of Law, University of Lampung. The results of the research and discussion indicate that the Public Prosecutor acts as a peace facilitator between the perpetrator and the victim, a supervisor of the agreement process, and as a party that determines the feasibility of terminating the prosecution by taking into account the formal and material requirements in accordance with Prosecutor's Regulation Number 15 of 2020. Factors that influence the success of the implementation of restorative justice include clear legal substance, integration of law enforcement officers, support of facilities and infrastructure, community involvement, and acceptance of legal culture by the community. Obstacles that are still encountered include, among others, the lack of public understanding of the restorative justice approach in the criminal justice system in Indonesia, as well as the potential for abuse of authority by law enforcement officers. The research suggests that the Prosecutor's Office should be more proactive in promoting restorative justice to the public, enhancing the capacity of Public Prosecutors as peace facilitators, and strengthening and expanding the presence of Restorative Justice Houses and existing digital resources. Furthermore, regulations regarding the termination of prosecution based on restorative justice should be included in formal criminal law provisions or can be included in the applicable laws and regulations.
