Program Kredit Usaha Rakyat (KUR) diperkenalkan oleh pemerintah pada tahun 2007 melalui Instruksi Presiden No. 6 Tahun 2007 dan diatur lebih lanjut dalam Permenko Perekonomian No. 7 Tahun 2025 tentang Perubahan Ketiga atas Permenko Perekonomian RI No. 1 Tahun 2022 mengenai Pedoman Pelaksanaan KUR. KUR merupakan fasilitas pembiayaan modal dan investasi dengan penjaminan yang bertujuan memperkuat sektor riil dan pemberdayaan UMKM. Tahapan dalam perjanjian KUR antara PT. Bank Rakyat Indonesia Kanwil Bandar Lampung dengan debitur serta kepastian penyelesaian apabila terjadinya wanprestasi merupakan aspek fundamental yang perlu diperjelas untuk memastikan kepastian hukum dan perlindungan bagi kedua belah pihak. Jenis penelitian dalam skripsi ini menggunakan penelitian hukum normatif empiris dengan tipe penelitian deskriptif. Pendekatan masalah menggunakan pendekatan normatif terapan dengan menerapkan metode non-judicial case study. Data dan sumber data menggunakan data sekunder, data primer, dan data tersier. Metode pengumpulan data menggunakan metode studi kepustakaan dan studi dokumen. Metode pengolahan data melalui pemeriksaan data, klasifikasi data, dan penyusunan data. Hasil penelitian menunjukkan bahwa persyaratan KUR Mikro di BRI mencakup usaha minimal enam bulan, tidak memiliki kredit di bank lain, dan memiliki legalitas usaha. Tahapan prosedur pemberian KUR terdiri atas tahap pracontractual, contractual, dan post-contractual. Penanganan wanprestasi dilakukan melalui penagihan berjenjang (lisan–SP1–SP3), negosiasi secara kekeluargaan, serta pengajuan klaim asuransi ke PT Askrindo dengan skema risiko 70%–30%. The People's Business Credit (KUR) program was introduced by the government in 2007 through Presidential Instruction No. 6 of 2007 and is further regulated in the Coordinating Minister for Economic Affairs Regulation No. 7 of 2025 concerning the Third Amendment to the Coordinating Minister for Economic Affairs Regulation No. 1 of 2022 concerning the Guidelines for the Implementation of KUR. KUR is a capital and investment financing facility with guarantees aimed at strengthening the real sector and empowering MSMEs. The stages in the KUR agreement between PT. Bank Rakyat Indonesia Kanwil Bandar Lampung and the debtor as well as the certainty of settlement in the event of default are fundamental aspects that need to be clarified to ensure legal certainty and protection for both parties. This thesis employs a descriptive, empirical normative legal research approach. The problem-solving approach uses an applied normative approach, employing a non-judicial case study method. The data and data sources utilize secondary, primary, and tertiary data. The data collection method utilizes literature and document studies. Data processing methods include data examination, data reconstruction, and data systematics. The research results show that the requirements for Micro KUR at BRI include a minimum of six months of business, no credit at other banks, and having a legal business license. The stages of the KUR disbursement procedure consist of precontractual, contractual, and post-contractual stages. Default handling is carried out through tiered collection (verbal–SP1–SP3), family negotiations, and filing an insurance claim with PT Askrindo with a 70%–30% risk scheme.
